    I am leagal stay this country for 10 yrs with due filling of taxes.
    Now because of my GC employer i got screwed up big time.
    140 DENIED on ability to pay.Didn't appeal or no MTR.

    If i start my GC process all over again, it is 10 more years to see it.What to do NOW?
    My EAD is valid through 2010.

    The article clearly states that she is born and brought up in the US. Folks, please do not include such people in the list - by definition they are NOT immigrants. Remember, there is a huge difference between native-born US citizens whose parents were immigrants and first generation immigrants. This important distinction is often blurred by the media, especially the Indian press.

    By that token, every US congressman including Tom Tancredo (whose parents are Italian immigrants) will make it to the list

    I really doubt anything will happen in immigration whether legal or illegal for 2 years. History shows immigration policy was restrictive when unemployment is high. It is not for discouraging any attempts but real situation now. Even business is not that much aggressive. During Lame Duck Session I saw IV was only one lobbying to attach Visa Recapture.

    But as usual CIR may be introduced including Eb reform in Feb. Lawyers site will get attention by their big analysis. IV Forum members will discuss again who is left out in the bill. Finally it will sit on Judiciary commitee and expire in December.

    But there is a belief that EB reform has strong support in congress. But if that is the case why any piecemeal bill is not coming out of Judiciary commitee for the past few years? Only reason told was everything waiting for CIR. The setback of Dream Bill shows that even Piecemeal Bill is also very difficult. Probably Still IV might have expressed optimistic view in Donor Forum about 2011. But for 2011 and 2012 " Hope for best and Prepare for worst'

    Probably it you take effort it may be helpful for future immigration aspirants. But most IV members may get GC before Eb reform happens.

    Senram, the bad economy is definitely a big hurdle to overcome. But your option of "hoping for best and prepare for worst" is not an action item. It is a passive act with no beneficial outcome. Hoping for the best is when you have put the efforts and leave the results to fate. Not putting the efforts at all (because we may be held hostage to cir, or the possibilities of peicemeal is slim) - is preparing for the worst!

    Think about it, without the ground work, we cannot hope for a last minute miracle.

    Basically your employer is saying that they cannot pay you while the extension is in process. However they want you to show up to work? So its legal to work but not legal to get paid? How the hell does that work.

    First of all, if the extension was filed, you are IN STATUS and AUTHORIZED TO WORK as long as your extension is not rejected. AND THEY HAVE TO PAY YOU AND CANNOT POSTPONE THE PAYCHECKS.

    Either they are really retarded or they are trying to get rid of you in 2-3 months and get free work from you until then while H1B extension is pending. That could be the only reason they are holding your pay.

    Indian Embassy received it on: Feb/02/2011

    I received both new and old passports on Feb/16/2011

    It took just two weeks for entire process...

    There is a big rumor going around about sending back the people with valid visas at the port of entry. Can the IO just send the people saying,there aren't enough jobs? I definitely think it is not that simple. But would like to know what are the guide lines given to them. Like what could be the standards that should be met. How this is different for the people entering with H1b status and using AP. What are the options if somebody is denied the entry but is genuine. Please through your opinions as someone could be more prepared while they travel.

    I am no longer in the race. My race is over. But to look back here is what we did
    a) Visited Washington DC , mostly on our own expense
    b) Organized numerous meeting in NJ to increase the awareness
    c) Coordinated DC rally
    d) Handed overthe fliers at the India day parade urging people to come and help.
    e) On the negative side for few , I also participated with few others to make all IT jobs, zone four.

    What we were trying to do was not only for oneselves but ourselves. Unfortunately, the awareness is just not there. Ideally, I would have expected people with later priority dates to be more active but they are not . Almost all of "active" us had PD from early 2006 or earlier and most of them EB2. Now guess what, we are done and we could have been a great and powerful organization, but for your support. Hence, I have issues with the folks in our community for the following reasons
    1. Not looking out for themselves.
    2. Expecting too much from one group/persons and not taking inititative themselves.
    3.Not educating themselves on what is the difference between legal /law and administrative rules, DOC VS DOL VS USCIS.
    4.Not being able to analyze what can be done or cannot not be done.
    5.Just being afraid to even talk to a lawmaker.
    6.Asking those who take inititatives do things with an authority as if we were paid to do this on your behalf.
    7.Not realizing how much your are loosing or can loose because of your precarious situation.


    Folks,
    It is very important that the people with later priority dates for example 2007 or later for EB2 India and 2003 or later for EB3 India, assume leadership roles in IV state chapters. Currently, it is mainly the people with earlier priority dates who are active and they now after very long wait have started getting their green cards.

    We don't want others to go through the same long wait and want to continue the movement by passing on the torch to the people with later PDs. These people should consider themselves lucky as they have an excellent forum to organize themselves. For most others, there was none existed, when they started their immigration journey.

    You must all realize and appreciate that people have other priorities in life, work and family related. As they get their green cards they refocus to leading a Normal life and rightly so. Thus, it is upto the affected people to take charge now!. If you don't do it , this movement will die and your wait will become endless.

    Just in case you are wondering , my PD is Nov 2005 EB2. And personally, I intend to become inactive the day I will get my green card and refocus my effort on another volunteer activity related to Hydrogen Fuel promotion.

    Since we do not have citizenship, we can make ourselves matter to citizens. When we realize that average American citizens are the people whom we need to team up with, politicians will start listening to us. So far we have been teaming up with illegals.

    It is often said (and it is very correct) that divided we fall. So we have to stand as a team to success. The question really is, whom would we team up with?

    You are mistaken if you believe that the dems support amnesty and the reps support legal immigration. The fact is that they support themselves and will take on a policy that will get them re-elected.
    We do not matter until we make ourselves matter by holding them responsible....... hard to do without citizenship :(

    Isnt this a minor error, considering that my DOB, A# and the spelling of the names are all correct... just the first name and last name interchanged :-(

    I have an info pass appointment on friday.. what should I ask for ??

    If I have to re-apply, do I have to pay again ?

    We had DOB printed wrong on EAD card. Called the USCIS and they created a case and gave file #. We got a notice asking for support documentation. Then we mailed it with a detail covering letter and got new card. In your case they might ask you for processing fee also since it is your mistake. When you call dont forget to request expedited process (if you need the EAD very soon).

    Perhaps she could apply on the grounds of No Objection from Home Country. From what I understand, she needs a No objection certificate sent by her country's embassy in the US directly to the department of state.
    Once she get's the waiver, she can be in the US on H, L, or LPR status.

    Who in the embassy needs to fill that out? Is there a special form or is there a general letter stating that the Country Embassy in Washington has no objection of waiving 2 year HRR rule? Does it matter that her study while on J-1 was at least partially funded bu USAID?

    You got your EADs so enjoy. :D Are you looking reasons to get worry? ;) It seems first it changes status to "ordered for production" then to "Approved".
    For me it's still received and pending. :)

    so how come some see a message that your card has been ordered for prductions, and some like myslef only see a mssage that we have approved this case.

    We received our EAD and no message as such, ordered for production was seen on the status website.

    Hi,

    I have a question regarding Pending AOS status and Expiring I-94 and whether this is an issue. Last time when I entered USA using Advance parole, my I-94 was stamped with a validity of one year (which I think is normal) but now its expiring and my I-485 is still pending. I am working on EAD and I am EB3 ROW (priority date not current). Can anyone provide some details on whether expired I-94 will be an issue during pending AOS? Normally, I-94 determine the status but I am not sure while in pending AOS. I read lots of thread saying expiring I-94 is not an issue but have not seen any official note from USCIS or DOL saying so. My lawyer said this is gray area.

    I know lots of people will be in this situation specially because of July 2007 fiasco. Please provide your experience. Do we need to do anything with expiring I-94 during pending AOS with EAD?

    Yes, I understand what you mean. I have gone through numerous such anguish...but I have learned to avoid those traps. Yes, when my neighbor who came with a NIIT certificate in 2006 and got 485 approval the first week of August 2008 with a labor substitution, I did feel "fake" "cut the line" and "injustice" words boil inside me. But they didn't matter. When wifey ridicules your MBA from an elite school here, it does not matter. You attain a Buddha like stature.

    Life is never fair. Just keep on doing your part and things will fall into place...sooner or later. Mostly later for some of us unfortunates because of these examination rooms, ultrasounds or complete physicals.

    Hi there,

    Hope anybody has faced my situation, but if someone has and had already overcome the problem, I really need some info about it. USCIS sent RFE (Medical exams) back in Feb 17th 2009. On May 17th 2009, my case's status changed to PUT ON HOLD until more evidence is received, yesterday May 21th 2009, my attorney called saying she got a letter saying my case was denied for failing to send RFE, which is not the case we did sent it to the the right place (Texas field office), on the right time.

    We are filing a MTR on my case. Question is how long it may takes until USCIS decides to reopen my case, knowing that with USCIS you never know, but in average. This really sucks and unless you enter in a legal battle with them, only thing you can do is file, pay money and wait. Sometimes I think this is a BIG scam to make money.

    I really hope you can resolve this dilemma. On reading your post a couple of times the question that comes to mind is are your absolutely certain that the evidence was provided within the time frame allowed and if so do you have the proof. I ask this since if you left it to your lawyer you should be following up with them and asking to see the evidence for yourself. They may have messed, it will not be first time a lawyer has not done things in the correct manner.

    what is the interpretation of H1B consulting as per this bill. Is it allowed if the consultant is working at the client site but not outplacing the client's US employees for 180 days or more (before and after the recruitment) and also reports to the consulting companies employer rather than the client employer.
