    Hello,

    Guys And Girls: I Have Got A Radical New Ideas. Our Current Problem Is Rooted In The Artificial Quotas Created By Congress For Each Country. Can We Go To The Courts And Have This Provision Struck Down? If This Is Struck Down, Then Indians And Chinese Backlog Will Clear Up And More Visas Will Be Available For A Country Based On The No Of Applicants For The Eb Category From That Country Per Year.

    This not a plea for immigration. Green Card is not my Right and I m aware of that.

    1. On June 13th USCIS issued a July bulletin that got all of us Legal non-immigrants scrambling for getting medical certificates and other boat load of documents to apply for next step of Green Card.
    2. On the first day we could have filed July 2nd - USCIS reversed this, without giving any notice.
    3. Law doesnt allow USCIS to issue this - because; the Law is and should be predictable.
    4. USCIS says it approved 60000 Green cards in 15 days !!! (note it issued equal amount in last 9 months.) so how is it that they suddenly became so efficient. Just a question!.

    Regarding my story - I, my wife and my son of 3 months had to sit in doctors offfice 7 hours to get the appointment. Because of the shortage of "Certified Surgeons" which expire in One year.
    We had to make multiple calls back to our country to fetch documents that are needed. Like birth certificates, etc.

    None of us are complaining on what we had to go through to get what was needed.
    But I think its was a touch out of place and illegal for USCIS to issues an updated visa bulletin shutting all the Legal immigrants out - so that they do not have to manage "heavy workload".

    We are sending Flowers to Emilo Gonzalez to do a silent protest of his policies.

    THIS IS NOT AN IMMIGRATION ISSUE - THIS IS A PROCEDURE ISSUE (or Lack of it).

    Sorry if you have done so but can you briefly restate what the goals of iv-physician are? I am a MD PhD (MD from India, PhD from US) in residency currently, on H1B (so no J1 or NIW issues), and havent applied for a GC.....and to me superficially it seems that your issues are geared towards the J1 waiver /NIW community? I may be wrong, but can you elaborate if you have broader goals. Thanks for your time, and for taking up leadership of this community.

    I know it is such a personal decision but I'll still urge you to reconsider it. Normally I wouldn't mouth off my opinions in such personal matters but it will be a LOT of hassle to bring back the new born to US from India and even after that your child will be put in the same endless immigration Q we are all stuck in forever! On the other hand If you have your baby here he/she directly gets the citizenship!

    If there is no one who can come from India to help you in the months following the delivery it still can be done. Couple of my friends did have their kids here with no one to help them since their parents couldn't get US visa. It's definitely hard but still doable. Medical care (pre and post delivery for both the mother and the new born) here is really good as long as you have good insurance. At the same time think about how much headache you will be saving your kid down the line. It's worth the hardships you'll have to suffer for couple of months.

    WASHINGTON -- President Barack Obama said Wednesday he wants to begin work this year on legislation overhauling the nation's immigration system, firming up his commitment on a key priority for Latino voters and lawmakers.

    Obama's comments at a Cinco de Mayo celebration at the White House reaffirmed his long-held support for immigration reform. He went a step further than he has in the past by calling for the work to begin this year.

    Latino groups have been calling for Obama to deliver on his campaign promise of making immigration reform a top priority, with some activists and lawmakers in the Congressional Hispanic Caucus complaining he wasn't doing enough.

    Obama clouded the issue last week by saying "there may not be an appetite" in Congress to deal with another hot-button issue immediately after grueling fights over health care and financial regulation.

    There also may not be enough time left on the legislative calendar to take up a contentious issue with midterm elections looming in November, but by making the commitment Obama may at least be able to tell Hispanic groups he tried.

    Obama acknowledged immigration reform would be difficult to achieve and would require bipartisan support - something that's lacking in the Senate right now. And he made no commitment to finishing the process this year.

    But he said it was the only way to deal with the nation's immigration problems.

    "The way to fix our broken immigration system is through common-sense comprehensive immigration reform," the president said.

    "I want to begin work this year and I want Democrats and Republicans to work with me."

    Obama again denounced the law passed in Arizona that allows police to require people to prove they're in this country legally. He said federal officials were monitoring it for possible civil rights violations.

    Good for us that President is building appetite on this now, its expected.
    But lets make sure we help with some good workable ideas, else it will be a cup n lip situation.

    my employer does not share the I-140 status with me...

    Since he is not sharing I-140 status with you, it could be possible that he might have already sent a letter to USCIS to revoke your I-140. USCIS can pull out your I-485 application to deny it based on revokal of I-140. I don't think its a straight I-140 denial case, because in that case beneficiery would have an option to appeal; and usually USCIS can only issue an intent to deny notice.

    If I were you, I would try to sort out issues with my employer and mean while find another employer and transfer my H1-B and start the process all over.

    Goodluck my friend. Remember GC is not end of world.

    Very true ... GC/ Citizenship is a privielage not a right, unless you are born in USA. Let's stop ranting about how highly qualified one is and how miserable your career had been, just beacuse of you not having GC. This is simply an excuse to ones own failures and blaiming others. How did a plumber or security gaurd take away your salary? ... truth is you were weak to ask for raise or not competent to get one.

    I know you are going to vent out your furstation by giving me red dots, but little do I care. But remember my bottomline, when you point a finger at someone (thing) three of your own point back at you. If this doesn't work, use "if you spit on sky, it will fall on your face."

    It is ironic for a person with user ID BECsufferer is saying others should not express there concerns.

    If the child is born in india, when both(husband and wife) are in EAD, and no valid H1. Then the child cannot come to USA using H4. The child can come using visitor visa (B2) for short periods...

    Similary if you are in GC, then the following rule applies --- "A permanent resident of the US may bring a child born abroad to the US and have the child automatically receive permanent residency; provided that the minor child is brought to the US the first time either parent re-enters the US. This latter point is incredibly important." (Did a google for this)

    If you are in H1, then H4 is always there....

    According to German Consulate, EU law requires transit visa when traveling via Europe on AP. I requested the info from the consulate.

    Nope, you don't need Transit visa for Europe, I went last year via Germany.

    I opened SR in May so it took 4 months, it seems all these days the NSC guys were processing other applications, they got to the SR last week and started sending these status emails...

    I guess its just telling us that they are working on the cases... its alll good
