    S-corp can be opened by only US Citizens. You can open a LLC or C-Corp.

    You can try extension of I-94 at local CBP. I was in a simialr situation with respect to the status of my wife.We did not have the issue of Passport expiry in our case though .

    Long story short....Her I-94 and H4 Visa expired on Oct'07, though she had valid H4 extension until Sep'09. We realized this only in March'08. Please find an details of my issue in the below thread I have posted before

    On suggestion of my attorney, we went to the local CBP office at PHL and the officer corrected/extended the I-94. I just wanted to share my side of the story where the local CBP corrected the I-94 even after being out of Status.

    I would do both. Change your address with USCIS & also ask USPS to hold your mail.:)

    You are definately a High Skilled :):):) Yes, that's smart way.

    1) First apply "Hold Mail" on the day of moving at least for 15 days.(USPS web site provides selection of hold start and
    resume date) and DO NOT request " Forward mail to new address" with USPS
    2) Move yourself
    3) Perform "Change Of Address" through filing AR-11 and by calling USCIS after moving to your new place but ASAP. AND
    Do both calling and filing on line AR-11form.
    4) On the 10th day of moving mail "Change Of Address" form to USPS with From: Old Address To: New Address
    5) On the 12th or 13th day call USPS and lift up Hold and request USPS delievring all held mail to your new place.

    Note: Only thing you may have to confirm with USPS is that whether USPS would mail you the held mails to your new address or not. If you have moved to new city then it is the only alternative and if USPS cannot deliver held mail to new address then you can not take that route. If you are moving within same city then your life would be bit easy in a sense that you can pickup mails from USPS (Though you have to select that option while requesting "hold mail" for the first time)

    I feel 'people not donating' is not directly connected with money. For example lets aasume tomorrow USCIS opens up a premium service for 485 approval saying you pay $50,000 and your 485 processing will be completed within 6 months and this queue has unlimited visa numbers. Will people not pay 50K and get into that queue? I would say 50% of IV members would pay and make use of that.

    The point is not about affordability.

    Mine was transferred from TSC to CSC on June 21, 2007, no updates since then. CSC is not even processing 485 applications. Customer service told me to wait for atleast a year.

    Wait for a year? I don't think the CSR knows what s/he is talking about.

    Keep in mind that F1 is not a dual intent visa. It is a strict non-immigrant visa. If the applicant has the pre-conceived intent of acquring permanant residency based on I-130 before arriving in US, and using F1 for immigration (GC) purpose, it will consitutes as a fraud.

    August 5th 2008 was the earliest date available. Expedite request was not done by Infopass officer since the previous EAD was still valid till August 15th 2008.

    I don't understand why they expect us wait till last minute even for very Important matters like this , very sad.Good luck to you.I may face similar situation like your wife , my current EAD expires on 19th Sep and I am still waiting for my EAD.

    Petitiononline site is a junk website.
    It is a website of people who want to stay unknown and want to feel fake happiness that they have signed a petition. Who cares about fake signatures on that site. I can sign as Bill Gates or Tom Hanks or Julia Roberts on that site and nobody will know. I can even sign hundred times and make up numbers.
    Those signatures are useless.
    Only illegals should be using petiononline site or should be afraid of sending letters. Unless you suggest we are all illegals and overstayed or are without visas in this country.

    Are you suggesting that the very idea of collecting signatures is useless or that websites like petitiononline are useless? or both?

    I am not advocating using petitiononline. If fact I had never even heard of it until yesterday. I did NOT suggest we drop writing letters and collect signatures. We, as in IV community should write letters.

    My point is that there are people (not IV members) out there who are willing to support our cause but are (at least in my opinion)understandably reluctant to write a letter to the President. Are you suggesting that support from these folks is no use to us? We need to tap into those people and provide them other options to support this cause besides writing a letter to the President.

    Remember, the reason why undocumented workers are getting so much attention is not just because they are themselves writing letters and running campaigns. Its more so because they have strong support from people outside that community.

    Websites like the one mentioned above maybe useless, and collecting signatures may not be the most effective way. But we ought to be more creative and find ways to get support in other ways. Suggestions?

    This is an email from my Lawyer. Gurus what do you think??? Is it a money making stunt or???
    The Department of State (DOS) and the Immigration Service (CIS) have created a cruel situation. In mid June, DOS announced that all employment-based visas (except other workers) would be current in the month of July. That was exciting news. However, on the morning of Monday, July 2nd, DOS announced that all employment-based visas had been used for the remainder of the fiscal year and that such visas had become �unavailable�. At the same time, CIS announced that it would reject any employment-based application received on or after July 2nd. The new fiscal year begins October 1st. It is very likely that the employment-based third preference cut-off date in October will be August of 2002! Thus, it could be several years for a visa to become available again.



    Response



    The American Immigration Law Foundation (AILF) has indicated they plan to file a lawsuit against the CIS to require them to accept for processing all employment-based cases filed in July. Will the litigation be successful? Unfortunately, we do not know what the outcome will be. This process could take several years. If there is a successful lawsuit, probably the only people who would benefit would be those who actually had applications rejected by CIS. Individuals who did not file and have CIS reject the application would probably not benefit from successful litigation.



    What Does This Mean For Me?



    You must choose. If we file your application during July, it will be rejected by CIS and the documents returned with the filing fees. When a visa becomes available again, there would be additional legal fees to prepare and file it a second time. If you do this, it would be with the hope that there is successful litigation (which again, could be several years) and that all those whose applications had been rejected would be allowed to resubmit the application and receive interim benefits. Your other option is to choose to simply wait for visas to become available again (that could be several years). If you choose to go forward and file in the month of July 2007, we need all necessary documents by July 15th or we may not be able to complete all of the work. Please let me know as soon as possible so I may get the document checklist and questionnaires to you.



    Which Should You Choose?



    We cannot tell you which you should choose. The choices are: (1) file now, be rejected and incur additional legal fees once we file your case the 2nd time. This is in hopes of a benefit from a lawsuit that has not yet been filed; or (2) not file now and simply wait for visas to become available some time in the future. How likely is the lawsuit to be successful? We simply do not know and cannot make any predictions. This simply has to be your choice.

    My law firm (Fragomen) thinks that the chances of a successful outcome are very slim and they are kinda preparing us for long wait times (ofcourse nothing new with legal would-be immigrants!)

    I'm not sure if your situation is the same as OP's. In his case, he had a valid H-1B with company A. He applied for a transfer to B. Before he even got the approval he worked for B. Then his transfer was denied. So technically the only H-1B, and hence LCA, valid till now is for A. Wouldn't his work at B be considered unauthorized?

    As others have suggested, you can always go back to your previous employer. I have been in similar situation as to go back to the previous employer, after working with the transferred H1B for 3 months. My new employer was even worse than the previous one and I decided to return to my previous employer. I worked for them for 2 more years and then did a smooth H1 transfer to a 3rd company and working for them since.

    I agree with the bill, Phd deserves permanent residency, this one only gives it to certain fields.

    Permanent Residency will only given it to STEM (in a field of Science, Technology, Engineering, or Mathematics) and who have an offer of employment from a United States employer in a field related to such degree.

    US probably has a shortfall for these fields and wants to keep people from going back.

    Its quite likely that this one might be passed. This should be a good start if it is passed and should lay the foundation for more on these lines.

    Folks - we are in a situation where employers are gaming the system to their benefit and survival.

    In a tough economy - people will do what they think is the best for survival.

    Lets always be aware that this is an employer system and they always find ways to game the system to their advantage.

    The denials seem to be happening and Mathew Oh claims that the reasoning could be because "good faith intent did not exist at the time of 140". Such an ambiguous statement can have many interpretations and is a first hand example of what happens to you when you land up in a grey area.

    IV has given an excellent platform for us to stand up for ourselves and do something for ourselves.

    So lets do our best in constructive and productive discussion.

    I know in New York, you will *NOT* qualify for in-state tuition. It took the school we were trying to get my husband into (I'm the H1B, he's H4) ages to get a final decision, but when they did, not only did we not qualify for in-state, but we were to be treated as foreign students and required to pay the double tuition for such! The "nice" lady asked if we'd be able to get his greencard within 6 months as they could "fudge" it for one term if we could...

    read this carefully she is talking about another part-time H1 to work for second employer not EAD. At least that is my reading of the situation. so you lose H1 if you use EAD for even part time employment but it can be regained.

    No, she is just saying that one can use EAD or H1 for part-time employment.
