so it is only for filers after february? :confused:
This is what my lawyer said. If is for those that filed after Feb 2008 then they will have to wait for years to get their i-140 approved (EB3) or get it aproved almost immediately for EB1/2).

Good you bought it up. There are number of people who appear to be getting the I 140 RFE's.
BTW, Any one with Future employment got RFE. I got an RFE but still dont what actually has been asked. got to wait and see. How much does it usually take to recieve the RFE mail since it is updated on the website?

I am in same situation....I entered on AP in October' 08, MY I-94 will expire in October' 09.

your 140 may have been denied. They must have RFE and your company did not respond.

I really doubt anything will happen in immigration whether legal or illegal for 2 years. History shows immigration policy was restrictive when unemployment is high. It is not for discouraging any attempts but real situation now. Even business is not that much aggressive. During Lame Duck Session I saw IV was only one lobbying to attach Visa Recapture.
But as usual CIR may be introduced including Eb reform in Feb. Lawyers site will get attention by their big analysis. IV Forum members will discuss again who is left out in the bill. Finally it will sit on Judiciary commitee and expire in December.
But there is a belief that EB reform has strong support in congress. But if that is the case why any piecemeal bill is not coming out of Judiciary commitee for the past few years? Only reason told was everything waiting for CIR. The setback of Dream Bill shows that even Piecemeal Bill is also very difficult. Probably Still IV might have expressed optimistic view in Donor Forum about 2011. But for 2011 and 2012 " Hope for best and Prepare for worst'
Probably it you take effort it may be helpful for future immigration aspirants. But most IV members may get GC before Eb reform happens.
1) Strategy will probably be focus on piecemeal but if some CIR-like legislation comes up, then we push for it (not surprising since some of the Democratic Senators like menendez or guitterez might still push for it..who knows).
2) From our standpoint, what we need to do doesnt change. its clear that meeting lawmaker offices and estabilishing a rapport with them is the key. talk about the key IV provisions (part of advocacy pack..contact starsun for material) so they are aware of our plight. Then when pro-EB bill comes up, push the lawmaker to support it. during lawmaker meetings we should request them to commit to sponsor an EB bill. this is better than trying to call or meet lawmaker at the minute when bill is almost up for debate or vote. we have try to help them take or change their stance much before that stage.
3) Do not get discouraged by standard email responses..no one at the lawmaker office is waiting to specifically respond to our email (which is among hundreds they get everyday). initial email is only stepping stone to a follow-up meeting which is important.
4) If local state chapter is not active..take up the initiative and start messages on the yahoogroup/googlegroup most state chapters have (start one if you do not find one created)
5) Through the state chapter, create 5-10 groups of 2 people each and distribute the various congressional districts among these groups to meet with lawmaker offices. Schedule an appointment and contact starsun or other senior members for meeting materials. Do this as frequently as possible and share feedback with IV team. These meetings can focus on overall IV/EB agenda and when bill comes up, it can be a bill-specific meeting.

I responded to the RFE for photos and its been over 45 days now since the last LUD for RFE response received. Service Center TSC. Anyone else in the same boat and waiting since responding to RFE? What are the options? Wait for 60 days and then open a SR to expedite or infopass?

We did it 6 months back but I remember that everything was sent in a University Envelope and we just sent the very basic documents that were asked. Nothing out of ordinary. My wife's university has a department, which helps in filing the documentation and we just went through them. Again, I am not sure how big of a difference it makes when things are done with a stamp from the Univesity on everything (like they attested some of the documents that we sent). There was also a letter from the University explaining the offer given to her and everything.

Hi friends i was planning to go to toronto, CANADA this weekend for stamping my 3yr extension .My 7th yr extension is till April 16th.So after reading what chandu wrote.Can somebody please tell me is it advisable for me to go one month in advance for visa stamping as my current visa is valid for one more month.Can somebody pls help on this.I have already booked the tickets & hotel.
My employer told me, as I have a valid stamp from same company, I must wait till it is within 10 days of the stamp expiry (mine is may 29th, 2007) so I must go only 10 days before that date, but if it is a different company we can go.
Can anyone confirm what my employer said?

most of us spent a lot last year on attorney fees, USCIS fees and medical examination fees.
wanted to check if any of this is tax deductible or not ? i read in 1040 form that certain attorney fees are deductible. however these expenses to me looks like personal expenses....

You can claim some portion of it. I am not sure about the exact number. But yes. you can claim it for sure.

I have a related question. If my I-140 is approved and if my Passport expires in 1.5 years, can I still get 3 year visa? Do I need to renew passport for 10 more years before I applu for H1B for 3 year extension?

Here is my situation: I have a SSN, on H-1B for the past 4 years working all along. Filed for I-485 and got my EAD. From India.
My wife is on H-4 no SSN. We are trying to file for her H-1 B this year. I know its only a 50% chance (may be less).
Now, can I defer my 2007 tax filing to say October? If so, what is the procedure to defer tax filing to either October or later? If she gets her H-1 B approval notice in June can she apply for SSN in say July? Assuming she gets her SSN in July, can we both jointly file for 2007 taxes in say October?
Will my strategy work? Please advice. Thanks in advance for your responses.
