With Shiela D, the problem is not hefty money but also an iffy acceptance with the INS. Atleast for mine, no acceptence with INS even after giving Shiela what she wanted! And moreover, a denial of this sort adds yet another fowl feather in your hat!!

No, that's is not correct, the document says '(if) you filed your I485 application with the USCIS Chicago Lockbox facility, file your Form I-765 with the following (Chicago Lockbox) address' - which is not applicable in your case.
I believe, download I 765 instructions. See Page 10 and check which state you are in. Basically, either it will be Nebraska Service center or Texas Service Center for filing address.

I am assuming that you have an EAD or have found another H1B sponsor.
In case you have, do the following:
(1) Get a letter from them stating your experience details.
(2) If you know they enagage in un-ethical and illegal activities (like filing fraudulent H1B), collect some evidence of it, if you safely can
(3) Compose a 3 line email:
Dear"desi consultant",
Due to personal reasons, I am will be unable to pursue further employment with your company, with effect from (give date).

Did your lawyer forget to attach the info of I 140 in I 485?
I think while filing I 485, you have to let USCIS know about the status on I 140. whether it is approved, or pending and the receipts and all that....
Get on this ASAP. Talk to your HR and Lawyer both.

I remain an optimist. From what I have researched, it seems that CIR might be taken up in October (if the economy improves, and as we have seen recently, it is starting to cooperate). This is coming for sure, so we have to start getting ready from now!
My question to our forum is, what do you think CIR will look like? From your research and what you might know, from the legal standpoint, are we looking at:
#1 - A points system?
#2 - A change in country caps?
#3 - A combination of #1 and #2?
What do you guys think?

I will be travelling to INdia during the month march/april, get my passport stamped and then proceed in US for I-140 & H1-B extension.
Are there any risks involved here? My current H1-B expires in August 2007.

You probably missed his question. He is worried that CVS might not file her H-1B in a timely manner which would result in her missing a chance at the lottery. As a back up, he wants to file through a consulting company.

@roseball - I am kind of surprise from your answer. I do not think it is possible currently(given economic situation) to post a job position and accept 0 applicants. Unless the job description has rare minimum requirements.
Company (Fortune 500) is currently interviewing the candidates and I am hoping the lawyer will be able to build up good case to reject the applicants.
Does anyone of you have information as to how many applicants were applied during your recruitment process? So I will be able to get an idea of that I am not in a exceptional situation.
I would appreciate all your comments.
If lawyer is involved in the recruitment process, its illegal and your PERM become invalid. Yes, as others pointed out if there are any qualified candidates the company can not file the PERM. Thats the law.

In some (probably most) states it is illegal to have any contract that forbids you from changing jobs. The reasons go back to slavery. It would be really hard if not impossible for your employer to enforce this contract. What do you think they will do if you just walk off the job? Get cops on you and make you work for a year ? No way... So if they are not withholding any of your money back, these contracts generally have no value (Legal or otherwise). The only loss to you may be the unpaid wages and bad name after you tell them you are leaving.

Mine took 5 business days to arrive. Both lawyer & myself received copies of RFE. It has a golden paper with Immigration officer # incharge of your case. You need to include this paper on top of your response while mailing back so that the papers reach the officer.
For paystubs BC and other queries they give you 30 days but the catch is the 30 day counter starts from day you receive e-mail so by the time you receive the letter with what is needed you have already lost 5-7 days.

FYI - what is the PD on your approval notice of I-140. The reason why I am saying that they also had my PD incorrectly on my approval notice of my I-140. I just got it changed three weeks back. This is serious - sometimes USCIS assigns the ND/RD as the PD which is an issue. Hust double check it

As far as I can tell, your situation is really bad. Without H1/L1 you can not bring her in this country period; unless, she comes on her own student/h1/L1 visa.
As far as adding her on to your I-485, it can be done when your PD is open/current. If EB3 06 is concerned, it may not happen for next 10 years. Please think seriously even marrying her on your current status.

Yes, when my neighbor who came with a NIIT certificate in 2006 and got 485 approval the first week of August 2008 with a labor substitution, I did feel "fake" "cut the line" and "injustice" words boil inside me. But they didn't matter. When wifey ridicules your MBA from an elite school here, it does not matter. You attain a Buddha like stature.
Life is never fair. Just keep on doing your part and things will fall into place...sooner or later. Mostly later for some of us unfortunates because of these examination rooms, ultrasounds or complete physicals.
