Count me in. We should post this thread or message to to recent GC holders who got their approvals in Sept/Oct and November..(including myself). So, EB2- I,C (2004) IV needs you. Come back :)
People who got recent approvals would be still subscribed to Sept/Oct master approval thread so our chances of reaching them would be higher. I , in fact, (re) proposed couple of weeks ago a new advocacy effort for reducing citizenship wait time..and there was strong interest among community members as wells as list of good ideas on how to go about it.

Hi, thanks for listing the steps. What do you mean by 'apply for EB2 using Eb3 pd' ? Is that something we state on EB2 labor PERM application? We don't need to file a new I-485 but notify USCIS to change the PD on existing 485..correct? Is there a formal process to make this happen?
Get your new employer to file a new labor using the Jan04 labor date.
And if your current employer withdraws your 140, it is okay as it is more than 180 days since filing your 485. your PD is locked for your own use.
These are the steps I would suggest.
1. Apply AC21 to move to new employer.
2. Apply new labor in EB2 using EB3 PD.
3. After your 140 is approved, move the existing 485 from your EB3 to EB2.

is the first website for the state of CA (AFAIR). It was started in 1995 or so. There are some negative things associated with CL, but it is a great resource for the general public. An example, in 2004, I had to sell an old car. Using CL, I sold it in a day (within 24 hours). :)

hi all,
I just received my EAD Card today. To my shock Immigration put the "Sex" Male on the card instead of Female. I checked with my paralegal, all my forms say female and my picture is defiantly a female.
According to Immigration customer service i should return the card and file for EAD again, and wait all over again.
My paralegal is waiting for the lawyer to answer and he does not think that i should return the card. As long as al the other information is correct i should not return it, and should be able to use it.
I'm suppose to start in Nov my new job.
has anybody else been in this situation? any advices?

No Medical report as you can submit later and now that is not part of Initial evidence ...only 485 application for you ( No EAD and APO also ) ...worth spending few hundread bucks ...

That's exactly what I did. Will send the medical report later when I get RFE. Did not use the lawyer this time. Just included my 485 application, photos, copy of I-140 etc. Also included a pre-paid USPS envelope with my address so that USCIS has one less step to do.

The 240 day grace rule is true. Even my H1 had expired and my H1B extension was pending. I continued to work for a month when my H1B extension was approved.

Yes, I did it, my H1B and I-94 expired in Feb 08 , company filed the extension 10 days before that, got the approval in July 08. I was working all along. As I mentioned, apparently USCIS gives 240 days of grace period once an extension is fiiled during which the beneficiary can stay/work legally and they expect to have a decision on your extension by that time.
The only thing once needs to worry is to file the extension before the current visa has expired.

2. Check the Processing times for that center.
3. If Processing Date > Receipt Date + 30 Then True
4. If true, call 800 # use the POJ method to talk to a rep and say you need to open a SR as you are outside the processing window.
5. If false, keep looking when the condition #3 is true.
Pardon me for being ignorant but How do you initiate a service request, all I get on NSC number is automated messages.

Let's say I switch to another employer using AC21 while waiting for I-485 approval. Then, I-485 is denied due to a simple reason like insufficient funds. Do I have to go through the GC process all over again, or can I just fix the problem and re-file I-485 using the old priority date?

As per my company lawyer 485 cannot be denied on insufficent funds/ability to pay etc ..this check is made at I-140 stage.
As per him 485 can be denied for health reasons, criminal background reasons or non compatibility of current job with the labor details...does anyone have a different opinion?

I filed my eEAD 45 days back, competed finger printing 15 days back, still I don't see LUD on my case; However, my spouse who filed 30 days back had 3 LUD, and a recent after finger print.
Can guys suggest, is this common. Usually after FP I should see a LUD, right? What are my options..:confused:

There is a non existant medicine called "chill pill". One of your options is to take that. No one can give you any guarantees on LUDs. They are used for internal processing of USCIS. Only realistic option you have is to wait out your 90 days and take an Infopass oppointment if you dont get your EAD by then.

The Infopass IO told that my file is now at NSC examination room. He could not tell me what that means - whether it is already assigned to an IO or just waiting there for an IO to be available. Any one else heard this? My guess is: it's waiting for an IO to be available :(
