I did not know about cross chargeability! It might work very well in my case..
I am from India and I have my i-140 approved and waiting for my PD(Oct07) to become current to file for my I-485 under EB2.
My girlfriend who is from Portugal, is on a F1 visa.
So if we were to get married - I can change my 'chargeability' to Portugal instead?
Isnt the chargeability solely dependant on the nationality of the primary applicant?

Thanks for your reply. My employer will not give me a copy of my old approved I-140 so in this case how can I port ?? Don't I need a copy of old I-140 to port priority date to EB2 or can I still port on the basis of the receipt number. I do not have copy of receipt also, I jsut have the receipt number for old I-140.

I think my question is that :

most of us spent a lot last year on attorney fees, USCIS fees and medical examination fees.
wanted to check if any of this is tax deductible or not ? i read in 1040 form that certain attorney fees are deductible. however these expenses to me looks like personal expenses....

NO you can't deduct perosnal attorney expeses. I work for a large Tax Company and I have checked with our CPA's. You sure can deductible attorney expenes ONLY if they are business related, never personal expenses. If it was the case, people will start deducting their divorce attorney fees and etc...

What happened to all the donors this month? Under 15% donated so for in August.. In July there was a mad rush for all to get a DONOR status due to a RED HEADLINE and every body thought the green card is hidden there. Come August and all the DONORS are not to be seen anywhere.
I was a regular donor and was changed to Sr. Member as did not sign in for monthly contributions. Did many signed in for monthly contributions ONLY for ONE month?????
I think IV need to change it’s policy of donation on Issue Based instead of monthly contributions. I am and will be available to contribute for Issue Based instead of Monthly contributions and just to get a DONOR STATUSr.

If the total duration of unauthorized stay in the US is less than 180 days then you should not have any issues. Google for 180 days unauthorized presence and you will get some hits. Also, please consult a qualified attorney regarding this.
My total duration was more than 180 days. infact it was around 3+ years since as I mentioned I did not apply for AOS/GC up untill late last year.
I went out of status in 06.
Got married to US citizen in 07.
Stayed out of status until nov 2010, when I finally applied for GC.
Permanent GC got approved last month.
My attorney says that I should not have any issues when returning. I just dont know how much I can believe her.

Well, its come that time where I am frustrated and fed up with my job and ready for a change. I am however, feeling rather trapped by this process and lost as I don't even know where I am in it. Maybe someone can give me some advice.
I have filed everything through a lawyer, who I feel works more for my employer than for me as that is who pays the fees. My I-140 was filed i'm guessing around April/May of 2007. I recently asked if that was approved, but apparently that is privelaged information i'm not entitled to. My receipt for my I-485 is Sept 2007 and I am currently working off an EAD, my second one which I recieved this past September.
I NEED to change jobs. I can not, and will not, stay at a place that I am miserable at. I just have no clue how to go about it. I already have a lawyer, but as I said, I feel they work more for the employer than me, and so I am hesitant and mentioning a change of employers for fear that will get back to my current employer. Would it be wise to find my own lawyer? I can understand your frustration. There is no need to get upset. This is US of America. You can get the information that you want and its within your rights. You can (try) call USCIS customer center and ask for the receipt number of I-140....most of the time, they don't give out over the phone but if you are lucky you can get the information. However, this is not the prudent way to get the information.
You can file for form G-639 with USCIS. Its the Freedom of Information/Privacy Act Request. Go to the following web site and initiate the request:

I believe, it would take 2-3 months to process the request.

I have slightly different situation. I have entered into US in Mar 2007 on H1B status at which time my I94 was stamped H1-B and dated until Sep, 09.
During July 2007 Fiasco, I was able to apply 485 and is pending. However, I never used EAD or left the country so far. When my I 94 expires in Sep, 09 should I exit and enter back using AP or since my AOS is pending, I can continue to stay after I 94 expiry.
Any words of advice will be appreciated..

there can be a problem of explaining why the labor is not filed in NJ. Most consulting firms dont file labor again and again ( I have a friend in PwC and he says PwC files for another labor if its outside drivable distance) when consultant moves form state to state for project like nomads.
The regulations clearly state that the H1B is location specific since a large part of the paperwork regarding the visa is about prevailing wages. Its pretty astounding that most consultants are not even aware what an LCA is although they travel from place to place like nomads. I think recent events clearly show that the law is serious about going after violations this time.

Already joined the state chapter.
Don't get me wrong. It's been observed that you always end up saying "Join the state chapter". Not sure if people really go with it anymore with the same old comment over and over again among the posts. Ofcourse if they want to join they will in anycase. Reminding them n number of times for each and every post may not fetch much I guess. Is this repeated comment fetching or loosing the impiortance. Personally I think, atleast it is making to loose importance.
It would be much nicer to have suggestions and discussions to the question than advise to join.
Anyways take it easy.

Can the MA state chapter get in touch with the governor and get his support/educate him on IV?
Thank you retropain for posting this information for everyone. Such information gives us an opportunity to identify people whom we can contact for awareness and support.
every member is an IV and we all represent IV. Instead of suggesting IV to do something it might be a better approch on the forums to do things we can do ourselves and encourage others to do that same. IV can pitch in whenever any support or advice is needed or there is something that involves a much larger effort. so I would urge everyone to send a brief note to The gov. thanking him and asking for further support and help in getting relief for legal immigrants. Let him know that there is a huge backlog and legal high skilled immigrants have to wait sevaral years and how it affects american competitiveness and immigrant's lives.
