    Please could someone advise?

    My priority date is 8/2004 and I have I-485 pending for more than 180 days, I-140 approved. I will be very likely fired before I get green card. I would like find safer job
    with same job title as my application is. I don't want use EAD and keep H1B because it allows to appeal if GC is denied.

    Is this correct procedure how to change job?
    1.my new employer needs file I-9 using my alien number (from I-485).
    2.Invoke AC21
    - cover letter
    - offer from the new company
    - paystubs from new employer (if available at time of filing)
    - 485 receipt
    - 140 receipt
    3. my H1B will expire in 2011. If I invoke AC21 do I need ask new employer fill H1B application? Can they have reason don't do it? Can I pay fee $320 by myself?
    If H1B application is required upon Green Card portability to new employer
    and only following is needed so it better don't use EAD
    Form I-129 ($320) can be filled online at USCSI
    Latest resume;
    One or two latest pay slips;
    Photocopy of your existing H-1B visa approval;
    Photocopy of your existing valid visa;
    Copy of valid passport;
    Photocopies of the Form I-94 (Arrival-Departure Record);
    Copy of your Diploma/Degree certificate; and
    Copy of your social security card.

    Please could you let me know if I am wrong on anything?

    I also don't understand why there are some many recommedations to contact lawyer.
    I think I need on first place find job so I could provide employment verification letter when
    they will be adjusting my GC and make sure new employer fill I-9 so I would have legal status.

But congressman Flake proposed this in 2008 and it died very soon. I hope it will gain some momentum this time atleast.     Dear friends,
    Could you please advice me on the particular topic at hand.
    I have filed for a H1b Visa through a US based small consulting company. I was in US working on a L1 visa with another company when I filed for an H1b through this small company. After that I retuned to India where I am currently based out of now. I am supposed to go and get my H1b visa stamped in the near future.
    However, over the past few months I am not getting comfortable feeling in joining this small company. I find it difficult to get in touch with them and also do not think they are professional in their operations. Could you please tell me what I need to do if I do not want to join this company? They have made me sign a contract where it is written that if I do not join their company after getting my H1b petition approval, I will have to pay them a certain amount of money towards lost opportunity/expenses etc. My SSN is also mentioned on the contract. Could you please tell me if contracts like this can be enforced and if they can sue me for not joining their company?

    I hate to be the one to have to make this argument here as I deeply sympathize with everyone who is a potential DREAM Act beneficiary, but there is a logical paradox in this bill that I cannot simply overlook.

    If this bill were to pass and be enacted into law, what would be the next step for some two million undocumented aliens who would benefit from it? Obviosuly documented and legal beneficiaries would be able to drop their visas and embrace a level an unprecedented level of workforce and social mobility previously denied to them. However, I can not with say with confidence that the newly-documented beneficiaries would be able to enjoy the same priviledges.

    Primarily, the cost of obtaining a college education would deter most beneficiaries from being able to fulfill one of the key requirements for full legalization. Just because someone is allowed to go to college does not mean that they would be able to. If you think that college loans will enable your dreams, unfortunately you are sadly mistaken. Current loan underwriting standards are too restrictive to allow someone with zero equity and zero income to secure a loan. College takes years of financial planning for most middle-class american families with a steady annual income well above the national median average. As someone who works in Finance you would have to show me one hell of a model to get me to me to accept the risk of underwriting a loan for someone who has no tax history and no real source of income, only a "DREAM". In-state tuition programs or any federal assistance would put an enormous pressure on the taxpayers and would bankrupt the underlying program funds. As a taxpayer myself I would be furious to know that my taxes are going to fund the education of people who did not equally contribute to the pot to begin with, but are now lining up to reap the benefits of my hard work. Public discontent would quickly halt these lending practices and present newly-legalized beneficiaries with yet another dead end.

    The two-year requirement as it is written into this Bill is a joke as well. If you want to stay and work in the US you need a minimum of a Bachelor's. A 4 year degree is the only way to go, and as I said before, plan to spend close to 200k on a decent diploma. I have been fortunate enough to attend college for free but have friends who have great jobs, paying more than 60-80k and are struggling to make their monthly loan payments which can be in excess of $1500 per month.

    Lastly, this Bill does nothing to solve the problem of the other 10 million undocumented aliens residing in the United States. The beneficiaries of this act would be able to do very little to help their parents, siblings and relatives who would still be stuck without a status. To be honest, I am completely against general amnesty knowing my family's own legal struggles with immigration. It would simply be unfair to the thousands of highly skilled workers and researchers stuck in Visa limbo waiting for their Green Card applications to come current. Allowing illegals to cut infront of them in line would be the equivalent of a school bully cutting you in the lunch line to claim the last cookie. Unfortunately, the only reason there are 10 million undocumented residents living in the United States is labor economics. Due to their status they have to work for less, much less. If they were legalized many of the jobs they currently fill would evaporate as paying a "fair" wage would bankrupt most businesses (landscaping, construction, restaurant) that currently employ these workers. This would leave them in a jobless and furher exacerbate the problem of poverty already plaguing immigrant communities.

    I am not an enemy of the DREAM Act. I support it and I hope that one of you can address my concerns and we can have a civil and fulfilling debate. Look forward to your comments.

    Good point. I think you missed her 'Benifits of retrogression' few weeks ago.
    It's a no brainier that immigration lawyers are in it for a good reason. I am not pointing fingers at any one specifically, but if this retrogression limbo continues they make more money and there is no two ways about that. Why do you think we will never see a Green card self petition scenario like it exists with certain other countries.

    I just have this scenario.
    If it sounds stupid just ignore my post.

    I am working for company A.
    485 has been filed and after 180 days( on the safer side let me say 240 days) i move to Company B.
    When i transfer to company B (i think it wont matter if i use H-1B transfer or EAD). Dont want to get into discussion about using H-1B/EAD.

    Now if i find Company C who wants to hire me after i get my GC or later on.

    Meanwhile USCIS sends me a RFE about my employement, what are my options.

    There are some grey areas like GC is for permnanent employement with sponsoring employer. But after acquiring GC you are can change or switch jobs easily. Atleast thats what many people presume but there have been cases when GC was revoke when people jumped jobs in short span after they got their GC when USCIS asked them why thier GC sgould not be revoked when thier intent was not to take up the job offer. But this does nto mean you can switch jobs, you can and you should they dont expect you bound the sponsoring employee for life time. In such cases discreationn of USCIS officer investigating the case comes into picture he uses his judgement like how much time the employee served the employee was it a fair enough move etc Was the intent for empoyement there in the first place etc. Hence you will find that most lawyer sites recommend not to chnage jobs for atleast six months afte getting the GC and mind you all these things are taken into consideration when you apply for naturalization.

    Now coming to the question it seems techincaly correct but it there are cases when people used AC21 and they have not been issued RFEs but there are cases when people were issued RFEs when they had used AC21. There is no clear cut answer to this but again the discreation the USCIS officer uses is the intent and secondly also depends the on period elapsed or time for eg. a friend of mine who filed his 485 in 2002 was issued a RFE in 2005 about his employement ,like whom did he work for now and if he did work for the sponsoring employer ,USCIS asked for an employement letter from employer .
    Changing employers when you have recnetly got GC can raise question about intent ,this might affect naturalization or questions raised right away after the move is made(even though this is rare unless someone complains ) but deifnately your LPR case is reviewed during naturalization .

    Was your FP appointment a "Code 3"? I managed to get a infopass appointment on Nov 14th(more than 90 days from receipt date) just to be on the safe side. Lets see what happens.

    I think adults (14 and above) have Code 3 and children have Code 2. Anyway, I have a feeling that they are processing by receipt dates.

    No you can file for h1b extension only 6 months before expiry.

    So get all your paper work ready and wait for 6 months time and then file early. By the way why do you want to apply 1 year in advance ? any particular reason ?

Now I do not want to be blunt and say that you copied pasted it from that search result into the forum. You should have atleast make a mention of the source or pasted a link as a courtesy.

    Now you may ask "so what?" but you can ask that "so?" for any thing and everything posted on this forum to argue on anything and everything. I will leave it there. Peace.

    Now, coming back to the topic of the post, I also mentioned in couple of posts above, based on USCIS memo, full time job position means 35-40 hours in most cases. One thing the attorney, mentioned in your post, failed to mention that H1B petition is linked to LCA and the employment letter included at the time of petition. If the employment letter (or job offer4 letter) mentions it is full time job then any significant change in that will require H1-B amendment. It is very common to file H1B amendment for changing from full time to part time, changing job location, or changes in job duties.

    One more thing, may I add here, is the universities tend to follow H1B rules and regulation more strictly then small time consulting shop.

    Let me know, if you still believe that significant changes in job hours does not involve H1-B petition amendment.
