All EB-3 India candidates would be eligible for Religious workers category after 15 years of wait. Their cases would be transferred to Religious worker category on its own. USCIS believes that after 15+ years of mental torture, they are better suited to work in temples and churches than in some software development center. Also, it is a point to be noted that 5 years after getting the green card, they will be able to become naturalized senior citizens. This process can only make them senior citizen of this country.

Get another attorney. Your attorney obviously doesn't know the basics of EB or is trying to get you in EB3 so he can keep extracting fees from you for years to come. Given that yr Vietnamese, if you file in EB2 you will get a GC in months. After that he can't take any more fees from you.

the current clauses in the INA are being amended and the EB clauses will be directly replaced with merit based.
therefore AC21 for all intents and purposes will apply to the "new clauses"

The clauses being replaced are not sub section by sub section and therefore AC21 cannot be used for the new clauses. There is no way that USCIS is going to interpret some thing like this in our favor for the fear of being sued by people like NumbersUSA, for over allocating GCs to Chinese or Indians.

My 140 and 485 got denies simultanously on april 18th .I found out when i got e mail .Neither my attorney or mu emplyer got 140 or 485 denail notice .after waiting 14 days i mad my employer call CIS and attorney wrote to CIS that we havnt recieved this denail notice yet .I kept the record of all this communacation because if u dont file MTR with 30 or 33 days then only option is apeal n thas if they allow u .I recieved both 140 and 485 denail on my home address on 25th day of denail and my attorney and employer recieved none .
Best aproach as some one said is call and confirm ur address n hope .If not call service centre directly .

Has anyone thought about the root cause of backlog?
I think it not really more people. Only 85K people on H1B come every year. There are 140 K greencards. All H1Bs do not apply for greencards,
So the problem is country limits. Can someone calculate what would be the wait time if country limit is completely removed.
They are numbers on paper.
But in reality, the screw up happens every year, because H1B does not have country limit but GC does.
Out of 65K (some years like 2000,2001 had 195K quota) came every year between 1999 30K (which is almost 50%) were from India and about 10K from China.
But every year GC has a country limit for India, 3000 for EB2 and 3000 for EB1. So they can process about 6000 per year for India. This includes Spouse and Children.
Out of 30K, assuming about 10K applied every year for GC, counting spouse and children the total applications are about 21K, that alone increases the backlog of GC.
I did not count the L1 side, which was equally / almost same as H1 in the past years.
To rub salt into the wound, out of 6000 GCs permitted for India, USCIS does not process all 6000, they process about only 4000 and waste 2000! Because USCIS is a Government Agency.

when all along they knew it would not > their workload. As Jock himself said, things won't improve in his term as DHS head, ie., WE WILL SEE NO CHANGES IN THE SYSTEM FOR 4 MORE YEARS. It's all a farce folks, thats the wicked world we live in.
Only way we can help ourselves is through legislation. Whining to USCIS will just piss them off even more & cause more harm to us down the road.

Who says that spouse's I-485 cannot be filed after the principal applicant's GC is approved. I just checked the latest I-485 instructions document [ http://www.uscis.gov/files/form/i-485instr.pdf ]. Just read the section "Who may file form I-485", section 2A very carefully. It clearly states that the derivative I-485 can be filed anytime after the principal's approval.
The conventional wisdom that the spouse cannot file GC as a dependent after principal's approval is all baloney.
Its not that one cannot file for spouse after getting gc, it becomes difficult for the spouse to get an entry into the US and will have to longer period of time to get here.

It can also be none of the above if restrictionists have their way.
There is a possibility of tightening the EB greencard process and H1bs. Do not be surprised if that happens because there is an effort in that direction. The bad economy is helping such attempts. It would be tough to go in this direction because the industry will oppose that.
What you can see is border enforcement, path to citizenship for undocumented and dream act included in it. This is because we are hearing that CHC is putting lot of pressure for an immigration reform.

A point system will come out as a fair system, where companies will have less control on filling a green card for the potential employees. Look at Australia or Canada their immigration system is more favorable why? Because of the point system.
Isn't that the notion Obama has been beating all this while? And if he had used a point system in the past, their is a strong chance he will use it again.
So what happened to US system? A lot of companies, DESI companies exploited the system, senator Dubin and all are not against immigration, but they want to stop a bad practice of H1b system. Isnt' that going to help all of us?

you can not go back to F1 once you file 485. You clearly have an intent to immigrate, so you wont qualify for F1.

I applied H1b for my wife when she is in India, now she came to usa on H4, She has I94 of H4 and she cant apply for SSN using H4 194. If she needs to apply for SSN she needs to go back to India / Outside the USA and come back on H1b Stamping where she get I-94 for H1b Status. But instead of doing that now she got her EAD, can she do the any of the below so that the EAD will not come into play and where she can still use her H1b and as you all Using EAD until 485 gets approve is not suggestable....Thank You..

Unless you have a notice that you are required to have fingerprints, you can be issued with an EAD without having to go through the fingerprint process.
I have just renewed my EAD for the second time and have never been fingerprinted.
The following is the statement on the USCIS:
Current Status: Card production ordered.
On October 26, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
How much time does it take to get this. I am going to be out of country on Nov 4th. will there be any issue If I cannot make it to the finger printing.

but pls make sure your wife really knows how to drive. Driving here though would seem easy is quite different from that of a foreign country. It wouldn't hurt to get some training before getting behind the wheels. It'll be worth for your wife's and others safety. Hope you take this well.

My lawyer didn't even give me any tracking number neither confirmed that my package reached USCIS. So I am pretty much like you without any information.

My friend became a US citizen after his GC. He got married 2 years before. His wife was in F1 and then got GC. She is 3 months pregnant now and need to travel with her husband's coffin to India in another two days. We want to consult with an immigration attorney soon, but before that we dont know what are the aspects we have to consult.
Following are some ex. questions. please provide your input for them..as well as any other missing items we have to consult with the attorney.
When she is in India
1. Will her GC be in valid status. How long can she stay in India without any paper work and return back to US. What are the paper works she need to do before going to India. Can she do the paper works in India itself.
2. If she delivers a baby in India, will the baby be a US citizen as the baby's father is a US (became) citizen (like person of american origin).
3. Can she claim Social Security benefits from India.
Does her GC status determines the collection of her husband's Social security benefit.
