I have a 3-years bachelor's in computer science and 10 years work experience in the same field (8 years in the U.S). I have been working for a IT company in which I am the only H1-B holder and considered an expert in my field of work. I have been waiting in line for 5 yrs for my LCA (EB3) to get approved and never tried to beat the system. I have been an active monetary contributor and been with IV since its membership was just in the tens.
The only reason I started this thread was to point out the inconstiencies in USCIS policy and ask for IV's help.
Everyone who comes to this country, comes here with one dream - a better way of life. Immigrants have been exploited all thru American History. Delaying the greencard, attaching the H1/greencard process to an employer etc, are all forms of exploitation.
Whatever your reasons might be, it does not give you any right to ask somebody else to go home.

We called USCIS to ask what's going on there. The representative told us she can only see the same info as we see, which is the I-140 case is still processing. She can not find the approval message, which we found by using the same receipt number 1 and 1/2 years ago. It's really sad. What should we do?

If there was an RFE, the online status will not be updated even after the approval. So, no need to worry about it.
How ever, in your case, there was no RFE. So, this message could be a glitch in their online system. If you want to make sure its still approved, you can possibly call the service center mentioned on your approval notice and clarify it with them.

Excatly, there is no compelling reason that IV has provided for us to join like the case below.
I feel 'people not donating' is not directly connected with money. For example lets aasume tomorrow USCIS opens up a premium service for 485 approval saying you pay $50,000 and your 485 processing will be completed within 6 months and this queue has unlimited visa numbers. Will people not pay 50K and get into that queue? I would say 50% of IV members would pay and make use of that.
The point is not about affordability.

Even if you get Birth certificate you still need 2 affidavits other than parents since the birth certificate is not taken at the time of birth.
It is easy and faster to get a non availability certificate and affidavits from parents. do you mean that if we register our birth details after few years..our DOB certificates are not valid?

My previous company is refusing to give me a official experience letter..even though i worked there for three years..
I am ready to file for my 140 and my attorney initially said that two Notarized affidavits from employees at the firm who worked with me will be good enough..
now he is saying he is not sure if USCIS will accept those affidavits...
has anyone used such affidavits to prove their experience.?did it work

Get letters from your Ex-colleagues or Ex-Managers who worked with you during your employment in that company. Get letters on plain paper and not on the letter head of the company where they are working Now!

It worked for me. I had an RFE for experience certificates and I did the same. My lawyer suggested it to me.
Similarly my friend who worked with me in my previous company needed it from me and I gave it to him. It worked for him as well.

This 30 day rule is bunch of bull. There is no written official evidence of it. Desi, show me this on any "Official" web site. Flat wrong statement.
You status is H1-B since Oct 2008. You had 30 days to start working (from Oct 1st). You are accumulating out-of-status days.

Actually, none of the bills are really controversial. It is naive to think that the bills which are not getting passed are being stuck because of some politicians' reasonable objection to some sections of it.
It the three bills are not passed it is purely due to political reasons and not due to any logical reasons. In these situations, you can come up with a bill which says "2 + 2 should be 4" and it will still never make it out of the committee!! :)
If there is still hope, we should focus on getting the maximum, and see what happens. Setting the sight low right at the outset is not going to help in any case.
I completely concur with you on that, in my previous two posts, I suggested we all should do something big, something which brings more visibility towards our problem. Why do you think Hispanic Caucus or other anti immigration associates have a lead over us? It is simple, "visibility"
Another suggestion is, we can file a law suite, something which is being discussed by other member, including myself. This type of activity will put more pressure on congress, as it is we are aware that congress is under a lot of heat due to its failures and laziness over some bills. They will have to do something in order to get re-elected for next term.
If we sleep on these bills now, chances are other bills will stack on them as we proceed towards the end of the year. The strategy now should be to, create some time of attraction towards our problems. For e.g. last year, the flower campaign brought us a lot of visibility. Something which was quiet well reported by media both in US & in India. We should again perform something big, like a DC rally, or a lawsuit and sending flowers again.

1) I switched to another company on EAD.
2) I worked for GC sponsoring company for over 2.5 years after filing I-485.
3) My current job title and responsibilities are almost same as earlier one.
Today I got a text message from USCIS with an RFE. I am still waiting for the letter in the mail.
Now:
1) What are all the documentation I need from my new (Current) employer apart from Employment Verification letter (EVL)?
2) Can i continue to work for the current employer while my case is in suspended state?

No you do not need to send photos after efiling, because you have physically go to USCIS center and get photographed and finger printed. My PD is sept 03 and already received my GC last year, but my wife's is still pending (initialy it was name check and now for no reason). Anyways, we received her EAD today... it took a long time though... she applied in May and received it yesterday... exactly after 95 days...
