Jokes apart, Call an IO or take a INFOPASS appt to talk to an IO. Its always easier if you can talk to somebody face to face....
I some centers you can get a INFOAPASS appt for next day easily

The delimma is if it's decided by Immigration that's it's my mistake i have to pay all over again. Put nobody know if i should pay the new fees or the july-2nd fees.
Also i asked if i should send a payment with the appilcation just to make sure the application is not rejected for not including the payment, i did not get an answer for that.

My lawyer gave me the same choice between applying I94 extension and visiting canada . I decided to travel to canada .
Any way you have choice of applying new H1 and getting I94 extension with the new H1 .

The one time 485 fee around $1000 + dollars is applicable only for all 485 applications filed after August 16 (even though the fee starts from Jl30) because of Jul VB problems. The one time fee is valid only if you file your 485 after that date and you dont have to pay on your yearly renewals. If you apply now and file EAD later you still ahve to pay 325 according to new fee and renew for the same amount every year until you need them.
I am not sure if thats correct. Bcos USCIS is trying to generate more money from now on to hire more people. So, Assuming i am goin to renew it every year by paying $375 and assuming u r goin to apply after aug 17th. You will end up paying only $1000 for 5 Years and i end up paying $350 per year for the next 5 years. Basically is a fee hike for people before aug 17th and for people after aug 17th, its not a fee hike, its a downgrade to less fees...AM I RIGHT????

I could mean something, it could mean nothing. At the end of the day somebody, somewhere touched on my case. I hope it means they are checking everyhthing is in order (140 approved), etc, for/before pre-adjudication, but then again that could be my optimism being too optimistic ;-)

I flew Lufthansa last december/this january and took the transit visa because the german consul in SFO said I needed, I had a expired stamping but valid 797. Nobody checked the visa in the airport but it gave peace of mind. If your price difference from other nonstop flights is about 200$ with Lufthansa, transit visa is still cheaper(at 45$ + about 20$ postage) and you get the clean aircraft,more legroom, blahblahblah...., An other option is to fly over the pacific through the friendly asian countries none of which need transit visa , and these routes work good especially for southern India.

Colorado is hardly a border state by any means, nor is it faced with a flood of illegals. How can a guy with one single point of argument keep getting re-elected to office? I suppose they voted based on party lines and not on the stance on issues. Either that or Littleton, CO has to be the most backward community in the US.
It is somewhat backward here in Colordado --especially smaller towns. There are very few "native" Coloradoans. They mostly have mullets and "native" Colorado license plate style bumper stickers. None are what I would call Native-American. The "natives" blame new comers for things such as litter. (Which obviously never happened before.) It is a natural progression of blame to blame Mexicans (for traffic accidents, rapes for example) for the many nativists here.

I got a letter from the local congressman supporting my parents' visa application.
The congressman's office also said that they sent an email to the consulate.
Their visa was rejected in spite of the letter.
I'm not sure if a letter from congressman really helps.
Heywhat: How did you get that letter? How do you contact the senator. I reside in Atlanta GA can you suggest me something please. What exactly was written on the letter. Please send me all this information, this will be a great help to me.

This should be a wake up call for people who have not started their GC process yet. I know some people have 4+ years in H1 and not aware of any of these issues going on. Even I was like that until I entered my 4th year. So let your friends know that they have to start their process and have at least a PD before this bill becomes law.
How will the amnesty affect our situation. I know it will overwelm the immigration services staff but the legalized illegals are not applying for the 290K employment based visas.

My lawyer asked me to mail again with a cover letter saying that since my checks were not cashed even after 60 days I am mailing again. I asked the clerk to ignore the new application if they see my original application by the time they open this.

My laywer had told me last year that the 3-year extension with approved I-140 was a one-time thing. However, she said that when the time came (meaning that nobody has probably reached the situation yet where they have had to renew their H-1s AFTER a 3-year extension was already given), that the laws/rules would probably change to allow further extensions. And so, I was just wondering, do those laws/rules exist or not.
You guys seem to say that they exist already.
The reason for the confusion is in ac21 section 104 which says "one time". That is they will only give three years one time and that is it. However, there is different wording later in 104 and 106 which says until the person obtains lawful permanent residency.
Since there is conflict in the wording; uscis clarified in a Q & A. below is the link. See part 3; question 3 on page 7.

That is true. I haved exact same situation and I reaserched myself and also my attorny has same idea. You must withdrow the first one in order to be able to file the second PERM with the same employee.
I am wondering to see if they change the current law soon.
What is your PD?
Mine is 2003 EB3 from rest of the word and really would not to worht it for me to do so.

H4 can work on EAD only upto validity of EAD.
If new EAD is not available he/she should stop working immediately.

There is no set time for this. It could be from two weeks to 6 months or more. Depends on a judge
