I am sorry to hitchhike on someone else's thread. It seems this person needs help and I do not have an answer. Here is my situation.
I am in India now, came for H1B renewal. Although my wife got H1B, they asked more documents for me. Both of us have AP. I decided not to proceed farther with the H1b thing and enter US using AP. Will there be any problem when I enter US as I have a pending visa application? Thanks for your advice.

I am not an expert at immigration laws but a similiar situation happened with my friend. Does not matter if you are fired or laid off. Even if the company sends the letter to USCIS to withdraw the H1 sponsorship your friend is still allowed to stay in USA till his H1 expires. He can work only for the company that transfers his H1, but he can stay till the H1 expires. The law only says that if H1 is transferred within 30 days it will be transferred with no or minimum questions asked. Greater than 30 days; there is no guarantee that H1 will be transferred. However my attorney has done cases even upto 4 to 5 months delay and the H1 has been transferred without any questions or RFI.

Hi Friends,
I am planning to use AC21 & join full time on EAD. I have couple of Qs in case I get EVL RFE. I was looking at today & noticed that people recently got some lengthy RFEs.
1. Does EVL need to say exact duties as per labor or could it be actual duties (which would be same/similar)? I am not sure if all employers would be comfortable in copy/pasting from Labor.
2. The letter must also indicate whether the terms and conditions of your employment-based visa petition or labor certification continue to exist.
Question-->What does letter need to say to cover this requirement. If new employer is not aware of AC21/Labor/I-140 and hires on EAD, he may not be willing to write Labor/I-140 in EVL.
All ideas & advice welcome.

I am not sure your friend has an option here. IF CANCELLATION reaches b4 his H1 TRANSFER papers.... and h1 Transfer get rejected he has to leave the Country. Ask him to work work with previous employer not to cancel H1.
I don't think this is true. Even if H1 cancels, he has 10 (or 7) days period to file new H1. I think it should be fine.
Why don't you ask your friend to come on the IV forum directly.

What happens to your current license while the renewal is pending verification? I guess they allow to drive till the expiry otherwise can't even leave the DL office. I'm confused after seeing this.:eek:

To the best of my knowledge there is nothing called H4 transfer. The only thing that matters is validity. If her H4 is valid then she is fine. If her H4 is expiring you should apply for extension based on your H1B.

Sorry amul, h4 transfer does exist, and every time you do a h1 transfer it is mandatory to do a h4 transfer too.
