    What was your details.....category and PD?? Your details on your profile seems confusing.

    Mine is EB2, India, PD 02/2002. Converted from EB3 to EB2.

    Since you are very much interested in my story i'll tell you my GC Journey.

    - 6 H1Bs (Since 2000)
    - 2 LCs (One RIR in 2002, PERM in 2007)
    - 1 45-day letter (in 2005)
    - 2 I-140s (1 in 2006, 1 in 2007)
    - 1 Layoff (in 2006)
    - 1 I-485 (in 2007)
    - 1 EB3 to EB2 converstion.
    - 2 EADs (2007-08)
    - 1 AP (2007)
    - 2 Finger prints (2007-08)
    - 5 SRs (4 no response, 1 useless response)
    - 1 Infopass
    - 2 Fax to NSC director with no response
    - 2 letters to NSC director with no response
    - 5 letters to congressmen and senators
    - 1 letter to First Lady
    - 1 response from FBI regarding name check.
    - 2 Ombudsman enquiry (1 no response, 1 useless response)
    - 2 responses from USCIS to congressmen enquiry (promising i'll get something before Oct 2008)
    - 2 more followup enquiry to Congressmen (because nothing happend until Nov 1st week)
    - 2 more followup response from USCIS (promising some status change before Nov 30th)
    - 1 I-485 RFE (just before Nov 30th as they promised)
    - Numberous phone calls to NSC

    RFE received on 11/24, RFE response recd 12/01

    12/04 GC approved.

    how can you say green card instead of EAD? I mean when you dont have a GC?

    You can apply for a tourist visa so that you can stay in some sort of legal status. But you cannot work while on a tourist visa. Then you have 6 months to sort things out and see if something works out.

    I know someone who did this that is why I am suggesting. But please consult your lawyer prior to this.

    The cons of this are that you are burning through your savings to support yourself and might have to face disappointment towards the end of the tourist visa.

    If you are laid off in the immediate aftermath of obtaining GC, ask for termination letter from the employer. Keep the termination letter till you apply for citizenship etc. so that you can always have proof that you changed employers involuntarily...

    There is no time limit to wok with the same employer after GC. Think about these scenarios

    1. A person comes into US on diversity lottery and can look for a job and work
    2. Spouse of the person who gets GC through employment based does not work at all or works after a year but applies for citizenship and gets approved.
    3. The Permanent resident manual does not mention anything


    I suspect that the lawyers are favoring the employers so that it is not a immediate loss of business and the employers can make alternative arrangements in this 6 months like promotions etc

    I got my 3 year extension after the I 485 application, As long as your PD is not current and I - 140 approved you can get a 3 year extension irrespective whether you filed your I 485 or not

    Great!! Is this your 'First' 3 yr. extension?
    I am curious to see it anybody ever got 2nd 3 yr extension (after 6 yr on H1) with I-140 pending/approved and i-485 filled but AOS pending.

    How its win for US...?

    Disagreements can lead to trade tensions and trade tensions can lead to lost sales for US industries.

    Also, I do not see why US would oppose the proposal as from US perspective, this is not an exception (as US has similar treaties with other countries), but a standardization.

    Thus, IMHO a win-win for both sides ...

    1st Question - Yes you can apply for EAD and AP on your own. But I would recommend that you apply for them now and have them ready instead of waiting till you get laid off. Those things take close to 3 months to get approved so better be ready. Most of us applied for those with AOS and have them with us even if we don't use them.

    2ns Question - I am not sure.

    I am now past the 180 day filing period for 485. Also, 140 has been approved. But my employer hasnt applied for my EAD / AP as I have a valid H1B.

    If I get laid off but employer promises no I-140 revocation -

    Can I then apply for EAD / AP on my own and look for a job thereby not have to leave the country for good?

    Is it ok to have a gap between H1B expiry date (say July 31, 2008) and start of EAD (Oct 1, 2008) when a person is in AOS?

    Did you enclose the original H-4 I-94 along with the I-539.

    What happens if the COS is denied, will USCIS return the I-94.


    My wife did a successful transfer from H4-F1 in her last semester and is now preparing to apply for her OPT. The university designated officials reviewed all her paperwork.

    We submitted bank statements as a financial proof as a proof to cover first year expenses. The F1 was approved in 6 weeks.

    I sincere hope Dream act pass. Illegal kids suffer more. Our suffer less. Parents made mistake. Why they pay?

    why do you think illegal kids suffer more? Isn't getting a visa stamped suffering these days? The whole argument about "parents made a mistake and why do you want kids to suffer" is a total BS i think. It is parents choice and parents know better about their kids.

    I am a July 2007 filer joined new company(1000+ employees) in Jan 2009 & applied for H1 transfer. H1 with old company is valid till January 2010.

    Now my H1 transfer is denied. I am 99% sure my company will not file MTR. It looks like it is their corporate policy. Most probably i will not even know the reason why it was denied. (again corporate policy).

    I need your valuable suggestion. What are my options here?

    1) Can i go back to original company if possible?
    2) Can i be able to do an H1 transfer if I find some other company? Will it be approved considering that MTR is not filed for current applicaiton.
    3) If I can file for H1 transfer with other company how much time i have to do it.

    I don't want to move to EAD as i have leave country if some thing happens to my 485.

    I earlier put this in a wrong category, so reposting here. Do any others have input?

    You would not have any issues if you get the approval from the second employer BEFORE the completion of the h1b revocation from the first employer. The h1b petition withdrawal process takes about 3 months.

    If my I-140 has been approved with company A and I only have 1.5 years remaining (out of a total of 6 years) on my H1, if I renew my H1 with company A, I know I will get 3 years based on my I-140 approval with them, but what if I transfer my H1 to company B before the H1 renewal stage, will I get 1.5 or 3 years on my new H1?

    To rephrase my question, in case I wasn't clear, does the I-140 approval with company A hold valid to get a new 3 year H1 with company B even though company B never filed for my green card and nor did company A renew my H1 after the I-140 approval?

    lol.. well then, we're probebly better off. I would have deleted it myself if it were bad enough.

    Personaly I think spirituality and religion are VERY VERY important parts of life, and often are downplayed, or shirked around because of the unpleseantness of a few individuals. Some of us (I've a feeling our reverend included) are probebly very soft spoken in opinion, and open to inturpretations from various factions.. at least as far as discussion goes.
    Being an Agnostic, Realist, Budhist, Communist I do know what it's like to have to walk away from certain conversations.

What has caused Joe Wilson to react like this, besides a serious lack of self control, is the provision in the proposed legislation that eliminates the requirement of using the "SAVE" system to verify whether someone who is an immigrant, is legally in the United States. Use of this program has stopped very few undocumented immigrants from getting public benefits, but has stopped literally thousands of U.S. citizens, mostly poor, from obtaining benefits because of their lack of accessible proof of their citizenship.

    I can certainly see both sides of the debate, and, frankly, neither side is being completely honest or clear. What is quite clear, is how immigration, and our broken immigration system, keeps coming up in the context of the debate of national agenda items, such as the health care debate.



    Several weeks ago I blogged on the danger that the tone of the Health care debate (http://ailaleadership.blogspot.com/2009/08/healthcare-debate-and-immigration.html)had for the coming immigration reform debate. Calling the President a Liar during his speech to a joint session to Congress is Exhibit A in what we have in store for the coming debate. If Joe Wilson the Immigration Lawyer can misrepresent the consequences of legislative language as straight forward as these two particular sections, we have to be prepared for the extraordinary misrepresentations of any positive aspects of an immigration reform bill. Whether it is "amnesty," "rewarding law breakers," "open borders," "Liars," or even "destroyers of American culture" we have to understand how to phrase and present the response. Without a doubt, the response from those of us who understand the need to balance immigration reform, with security concerns, and with economic growth has to be not only vocal, but focused. We, as Real Immigration Lawyers, must know the language of the proposed legislation, we must know the myths that are out there, and we need to be vocal in our response.




    Next week, more than 40 talk radio hosts are descending on Capital Hill for the FAIR (http://www.splcenter.org/intel/intelreport/article.jsp?aid=846)Annual Scare the Crap Out of Congress Boondoggle. The outrageous claims of the downfall of America caused by illegal immigration, along with similarly nutty myths will be presented as facts. Actual real news organization will cite the Center for Immigration Studies as a legitimate source of information. We must be prepared to call into our local radio stations, whose hosts are in D.C. next week, and be prepared to present the facts of immigration. Not by sugar coating the problems that are caused by illegal immigration, but rather by pointing out which specific laws are broken (INA 212(a)(9) anyone?) and how having a comprehensive solution can actually fix the immigration pothole in the legislative superhighway.
