I e-filed for my wife's EAD renewal on april 21st at TSC. Till now no replies and we had the fingerprinting done on May 7th 2008. We requested for expedite and the current EAD is expiring today(Augst 15th 2008). I saw in the earlier reply, that I can go to local USCIS office and get a temp EAD. Can you please confirm whether it is possible and has anyone got that?
Reply appreciated.

dixie,
That is true. So this just gives what I was saying more weightage. There is no need to get all worked up about this. You've got to wait at least 6 months, so put in another 6 months are you have satisfied the contract as well. In any case, wait for the GC, then evaluate your situation and make a good decision.

Hmm... before swinging bats... lets determine if the OP is without blame. From the looks of this, clearly it is a body-shop. Anyone who uses body shop in order to get GC (or even employment through H1) are just as culpable as the body-shop owners.

I am not sure if there is a thread created under "interesting topics" for discussing investment options in the US. If yes, we can close this one.
Besides the house, the 401k, the ESPP and the stocks (which I've always shied away from), would the IV community provide inputs on the following:
1. the various investment options in the US.
2. good investment consultants that you know of
3. approx percentage spread of your investments
e.g: 10% in stocks, 10% in 401k , 50% in the house purchase etc.
I know this thread is not relevant to immigration issues but those are being actively discussed in other threads.
If you want to know different investment vehicles, you can subscribe to any financial journal or magazine. But if you want to know more than what's just exists out there, and know about personal investment stuff without any bias, IMO get a subscription to AAII (American Institute of Independent Investors). A lifetime subscription (25 years) costs less than 300 bucks, and it is very well worth...
BTW, others in the forum mentioned about investing in gold, but make sure you don't invest in physical gold or art through your retirement account...Will end up paying penalties and stuff...

Please check with a lawyer. I doubt you can do it because you will need to go on a F1 for a full time MBA.
When I checked with a lawyer I was that when you go to apply for F1 they will find out that you have a pending 485 and might reject your F1 because it is a non immigrant status visa.

If CIR is introduced, following will be overall consequences:
1) Green card for all illegals(not legals) in US for 5 years
2)ALL cases under current EB resolved quickly to start giving GC to illegals standing back in line
3) People who dont have EB started yet are damned. They will face harsher Labor certifications and will have to wait even longer because 12 million illegals will be standing in line before they start their EB(or some other new) process..
In all, it about illegals not legals.

FYI...
Checked my bank account and the AOS, biometrics and EAD checks have cleared. Filed on June 30th and received at USCIS on July 2nd. The receipt numbers are on the back of the check.
What Bank (checks) did you use?
What time did it reach the USCIS

these one-time contributions are good. But I suggest the members should be encouraged to make regular monthly contributions, even as low as $25 a month. It's doable...just the cost of dining out with your family one time. that way the activities of IV can be planned much in advance, and it would lessen the anxiety of iv core.
just a suggestion, it might help the folks to contribute monthly if some of the activities are highlighted by core, so that the folks know how their monies are used. I know there are some issues to it, but a general info would help.

As long as you have a non desi consulting job, it should be fine. If you are with a desi consulting company, make sure that you carry a client letter with you. My friend was working with a multi national bank and got laid off. He got a job with a desi consulting company. He went for stamping in Canada since his marriage is in India next month and he wanted to get the stamping worry off his head. They asked for his client letter and after reviewing everything, they said that they dont think that his employer has the capacity to pay him and rejected his visa.
PS: This is my friend, not my friends friend or anything like that. He went back to India from Canada.

the justification was that since EAD is only for one year, if i apply now and processing dates remain the same, EAD should start sometime in nov and i will end up wasting my remaining h1 time if i switch to ead. so my next ead should be renewed some time next june. So the justification was that, if i apply for EAD in nov'08, my EAD would kick in feb and my next ead renewal would be nov'08. For a minute i confused myself here..:) Is it right??

My H1 got approved for 3 years (this is my 9th year on H1). Applied in premium processing, but got RFE. Approved in 2 days after sendign the response for RFE.
My daughter (17 years old) went for H4 stamping today at Hyderabad. They just asked for all required documents (passport, birth certificate, I-797 and I-129 etc) and said they will mail passport in 4 days. Hopefully she will get it stamped for 3 years.
I was not sure if i can send my daughter alone to the consulate and now just want to share with all of you that it can be done.

they need to have the "assimilation" amendment. the main rhetoric is about pressing 2 for spanish...so the assimilation amendment requires that you take TOEFL/IELTS or 8 credit hours of english in a community college. Community colleges can make some money from it...and the critics will be silenced. Then they need to show that they each have a Weber grill and that they grill out for at least 10 weekends per year....this can be the assimilation amendment.

Gurus,
I have a question regarding duration of legal status, as determined by the I-94 card.
- My brother's current H-1B ends on Oct 31, 2008.
- His company applied for 3yr H-1B extension in July, till Oct 2011
- The petition was approved and it has the approval notice date of Sep 5, 2008.
- My brother had to travel outside the country due to business reasons (left on Sept 9, returned on Sep 12).
- At POE, he got a new I-94 based on his current H-1B, with validity up to Oct 31, 2008.
1) My understanding is that his H-1B status in the country ends on Oct 31, 2008, as determined by the new I-94. Is this correct?
2) If the above is correct, then what are his options? As far as I know, there are two:
a) Leave the country before Oct 31, 2008, apply for a visa, and return with the new visa and get a new I-94 at the POE.
b) Apply for an amendment or extension of stay? I am not sure how this works, but I have heard people talk about it.
I will really appreciate if someone could share their thoughts and experience in this matter.
Thanks.
PS: I apologize for opening a new thread
At POE, he got a new I-94 based on his current H-1B, with validity up to Oct 31, 2008.
-As this I94 is latest one, the validity is still Oct 31 2008
- Either he can travel outside the country, get the visa and come back and get new I 94
- Otherwise go to the nearest CBP and get adjusticated. I am not very sure about the term. There were other threads in this forum about this. So please search.

My work is nothing in front of work done by IV core. I pray god that this rally is a blast.
We go through a lot of pain in this GC process... It is like a chain in the leg.

I have a expired H1 visa and will be travelling to India (plan to use AP for reentry) and will be stopping in Dubai for sightseeing for 3 days.
I understand I need a transit visa and would like to apply for one in US. I am flying Emirates and believe Emirates can sponsor for the visa. They told me to use CIBT (http://www.cibt.com) for applying for a visa. On the cibt site, it asks for a unexpired visa or a Green Card.
I wonder how others with expired H1s have got transit visa to Dubai.
Any help is really really appreciated.
You can get transit visa when you arrive in Dubai. One has to pay 100 Dhirams (=40 us dollars). During my visit and stay, I paid thru my credit card. I was never asked any question. I stayed in Dubai for a week with a relative of mine. My H1-B expired some time ago and I use AP for travel.
