If the travel is must without postponing it to at least to 2nd week of July, then she can travel, but before that complete the medical exam. Since you have time to apply until July31st, and more over August bulletin will be released by July 15th , then you can plan if she can stay until Aug 5th or she has to come in the last week of July. Just to mention, the fees are increasing effective July 30, 2007.

My wife and I are currently on H1 visas working for different companies. She is supposed to travel to India this sunday(Jun 17th) for a 7 week trip where she had a consulate appointment for stamping etc and is scheduled to return on Aug 5th 2007.
We are in a dilemma from yesterday when we came to know that I485 has become current. We are looking at two options but am not getting any lawyers to confirm as they are all at the immigration conference till Monday and I need an immediate solution. The two options are
1) She cancels her trip and we file and wait for the EAD etc before both of us go. However it is 80% essential she goes now.
2) She goes on Sunday, and I get all my 485 docs/health certificates in order and file and file in July. When she comes back in Aug I can add her on to my 485. Is this feasible and will this affect my 485 application?
3) SHe travels a week later and we can complete all documentation within a week? Is this feasible?
Any and all responses are appreciated and any other option we can consider.
One attorney got back to me saying if she adds on to my 485 in aug, there might be problems if it is not current and your application may also be pulled out of the quese. Is this right.
Long post, But I am in a big dilemma here and the trip is very important to my wife but the GC is on top of our priorities as well. Looking forward to getting a solution from the learned members in this group.

Are you sure you're not some guy from NumbersUSA trying to create a rift among legal immigrants? Why do you want to dilute the agenda of IV? We have to concentrate our efforts on one thing and get it done with. Then we can consider other issues. If everybody is pulling in a different direction, then nothing will be accomplished!

The President may not do any thing for Legal immigrants, except some lip services. because he is concerned about Hispanic votes. apart from CIR he will not move a small finger. if he does ,that will be really a great surprise and relief.
And in an election year CIR is not possible also. and CIR already dead for 2010 as everybody knows, And in the election if Republican party wins then CIR is doomed, till the US economy bounces, our long wait continues.
This President's hands are tied with lot of political blocks.

Take a look at who is against me?
1. people whose's PD is now CURRENT. they do not want more people to be CURRENT when their case is still pending.
2. People who are EB3. which is not going to move at all.
3. IV member who are not interested in pushing PD for the time being. People like June, 2006, July 2006 is not their interest to help.

hmm.. 3 year H1 extension with approved I-140 is an interesting point. I never thought about it. Thank You.
But I remember reading somewhere that you get 3 year H1 Extension only if your I-140 is approved and I-485 is not applied. Once you apply for I-485, you cannot get 3 year H1 extension instead you get only 1 year of H1 Extension. May be I am wrong. Can any one through some light on this please.
Also, when I am applying for H1 extension, do I need to mention about approved I-140 or pending I-140 or both?

I got my 3 year extension after the I 485 application, As long as your PD is not current and I - 140 approved you can get a 3 year extension irrespective whether you filed your I 485 or not

I am moving this weekend.....I have heard that USPS will not forward mail to the new address and hence I need to use Ar-11 to change address
My wife and my EAD's were mailed Nov. 27 and should arrive in a week I guess. however I will not have keys to the mailbox then. Rather than change address immediately with USCIS can I just have USPS hold my mail for a few days. That way my EAD wont be sent back to USCIS.
Will this work? Or do I have to bite the ubllet and change my address and have my EAD returned to USCIS and wait till they send it out again.
Please advice

My case is NSC-CSC-NSC. i-485 applied in NSC in July 07, transferred to CSC for data entry, transferred back to NSC in 2007. Welcome email received today.

Lazycis, according to u r 3rd point, If someone has a H1B sponsored by Comp A and has an 485 pending thro Comp A and received EAD thro Comp A, then he can still work on H1 for his primary employer Comp A and at the same time parallely work for Comp B on a part time basis using his EAD. Is this wat u meant? Is being on H1B and EAD at the same time allowable ?
That's my understanding. As long as you work fulltime for H1 sponsoring employer and H1 is current, you do not violate terms of your H1.

If whats passed in senate is not exactly same as what was passed in the house (ie. they add/delete stuff as its debated) then it goes to a committee where they reconcile everything. Once that is ok, it goes to the president for voting. the president can sign it or veto it and ask for changes. For something like this he will typically sign. So its upto the house and the senate... we are in the very first stage right now and there is a long way to go....

Hi,
One of my friend got fired today, he is on H1b. His American consulting company has sent visa cancellation as well to USCIS today. He has job offer from a big company sent visa transfer papers to their attorney 2 days back but they are saying transfer application preparation will take 1 week (you know how big companies work). What are his options?
Will he be in trouble if visa cancellation reaches before transfer petition? I heard employee have 10 days time to find a new job? Please help this is panic situation for my friend.

The office seems to have completely ignored the legal immigration points made in my email and is focused on illegal immigrants only. Email was sent end of May 2007 - response came in today. See below

Come out of WHAT shadows? The illegals are interviewing with Lou Dobbs in CNN. Is that Shadows?
You know what a shadow is? The PHILLY and DALLAS backlog centers. They are the shadows. That's what you call a shadow on the life of law abiding legal skilled immigrants. The ones who pay taxes for real with their OWN social security numbers.
And once again, nothing against the undocumented people. We dont care if you give them US passports before Christmas. But DONT do that please, at the expense of other legals. Dont reduce the legal category green card numbers in order to reach a deal (Grand bargain). You want to cut slack for the undocumented, do it out of your own political capital rather than throwing the legal skilled immigrants under the bus to achieve that Grand Bargain. This is people's lives you are talking about. Not some kind of medieval bazaar where you bargain with one group of immigrants against another. Legals have families too, and they too love to be stable and be beneficiaries of process that the have respected and followed with delays and without prejudice. How about bringing the legals out of the shadows?

What about skilled people who want to do consulting work for big bucks? It is rather immature to assume that all people who do consulting are not skilled or skilled enough.
