He does not have a hire/fire responsibility as of yet put his position level is that of a director. The exact role is still in negotiation.
He should be in a senior role where he has hire/fire responsibilities. If he can prove that , it is almost a cinch that he will painlessly walk through L-1A and EB1 and should have a GC in no time.
I know people who were simple software project managers with only 4-5 people reporting to them come in through L-1A and get GCs though EB1.

If you look at what Obama said on Airforce One the other day and the comments now, it is clear that he is not really committed in getting the CIR done this year. Just to pacify the Hispanic community we will probably have some kind of a start and thats about it.
That might be true. But there are many pots simmering in the background, and because of the events of the last few weeks incuding Arizona's new law, there has been a pressure building on the congress and the president.
We can help to continue to build this pressure by calling our senators and forcing them to take up the debate.
This is the right time, if we do not do anything now, we will have to wait till 2012 or 2013.
Please call our senators now.

Does everyone get a fingerprinting appointment for EAD renewal??
My first EAD card did not have my fingerprints. And it was issued 1 or 2 weeks after we went for our first ever Finger printing. I am guessing that was for I-485 and not for EAD.
I recently filed for EAD renewal in Aug First week 2008 and got the new EAD card in Sept first week 2008. And even this time the new EAD card does not have fingerprints on it. Nor did I get any appointment for Fingerprinting. Same for my wife. Although I am still waiting for her renewed EAD card. Mine came a week back. I am assuming her's is in mail.

Does anyone know if the Texas Plus Pilot will effect those of us with concurrently filed July 2007 applications?
Please does anyone know of EB3 approvals from March 2008 onwards? My lawyer believes it will affect only applications filed after February 2008. Is this true? Among a group of us that sent in apps at the same time, I am the only one that has heard nothing. The others were approved in Jan 2008.

This is how it works. If your 485 case gets stuck in name check and later cases are being processed, then you can approach your local senator, congressman, etc to call uscis and get your name check expedited. That is all they can do.
Politicians cannot and will not have a case processed out of queue. And of course, 485 final approval requires the availability of a visa number which can take years. There is nothing Politicians can do about this either.
So it is only a rare instance of a name check pending for long time where politicians can be of some assistance.

I am newbee on gc process. This is my case details
My Employer applied LC in Dec got RFE in last week ,but
stating the reason:
Please provide documents such as position descriptions, the percentage of time spent on the various duties, organizational charts, and payroll records demonstarting that the qualifying experience gained by the alien while working for the employer, including as a contract employee, was ina position not substantially, i.e., not requiring performance of the same job duties more than 50 percent of the time to the position for which certification is being sought, and/or documents demonstarting that it is no longer feasible to train a worker to qualify for the position.
Please advice me what should I reply ? How serious is the RFE ?

RFE is always serious. Dont take it lightly as they might deny approval if you dont respond or the answer is not satisfactory. Your RFE seems like for your experience though I am not very clear. What your attorney saying. Whats your GC category and how much experience it requires. What is your experience. Provide all the details and people would be able to answer your questions.

I had an RFE on my I-140 for Skillset. One of my colleague gave me a letter for the Skillset (i have experience letters from my company). But now INS RFE'd on skillset.
My previous company is not responding to me in a proper manner. But i have the L1B package submitted by them which shows the experience letter and the resume which shows my skillset and other things.
Can we use the L1B documentation to substantiate the RFE.
Any updates would be greatly appreciated.
I sent co-worker affidavits and a 5yr scertificate i received from my previous employer. I got an RFE from TSC to submit letter from employer with skills. Replied to RFE with supervisor affidavits (both the supervisors are not with previous companey anymore) and following suppoting docs.
1) original offer letter
2) initial L1 petition letter from previous companey.
3) An e-mail responce from previous companey statining that their policy does not allow them to provide experience letter with skill set.
4) W2's and Form-16 from previous companey.
My 140 got approved friday 10/10.

will they also revoke your I 140???? Once you leave company you should tlak to them and see if they can wait for cancelling u r I 140 that way you can port u r priority date to new perm labor.

Blue cross blue shield covers maternity but there may be a wait time of 6 months.contact an insurance agent and explain your situation. Its really a simple process and you need to understand a few words like out of pockets expenses, deductible, copay etc.
I know in michigan BCBS charges $133 for maternity rider. Getting an individual policy is very easy and dont let some guys scare about fine print and all that.The fact is they are too lazy to know about something new and they go preaching others to stay away from it too.

Just wanted to make it clear that you can change jobs immediately after the H1B transfer application is filed...you don't need to wait for approval.
When its a consultant there is always more risk with H1 as you must be aware of recent law changes

I am sorry to say, if you have not started your GC process with company B, as far as i know (understand the rules) you cannot file 485.
I might be wrong, so u should also ask senior members.

Check with your company CPA if he can issue an audited financial statement for FY 2001 stating that the assets of the company were >=$53000. If so, ATP for 2001 can be proved.
There was a CPA named "United Nations" who was active in immigration portal.com and IV, helping members with ATP issues. I am not sure if he's still doing it though. Check with him and see if he can help you with your case.
You can also file a 2nd labor via perm if you have a Bachelor's degree (4 years) and 5 years of progressive work experience. You can expect to get your PERM approved in 1-6 months provided DOL doesn't audit your case.
Note: As you were in US since 2002, I assume that you've already exhausted your 6 year limit on H1. Under these circumstances, I-140 denial will place you at the risk of packing your bags unless you meet the criteria of H1 extension beyond 6 years. Hence do the best you can. Good Luck.

Isn't it the job of the lawyer to review the resumes submitted and build a case to say why you are the best fit for this position? I am sure that's what the DOLis looking for as well - i.e. that the companies are following the protocol of advertising the position correctly and reviewing the resumes of candidates who apply. I think it will be a red flag if you don't show any resumes at this time esp. when the unemployment is so high as opposed to showing other resumes submitted.
Rule of thumb, lawyers are not supposed to be part of recruitment process, it should be the job of HR. Lwayer can advise based on evaluation completed by HR.:mad:

This is just a general question. Not my own case or anything like that. I'm in same boat as a lot of others - stuck in '07 fiasco. Not a case @ someone I know either. I'm just curious about this. And, I would like to hear from people who know cases like these.
As I understand it, if a girl who has never been to US marries a GC holder guy, the only way for her to come to US to stay with her husband is to go through family based immigration. Is this correct ?
If it is correct, then if the marriage happens today, will it take a few years before the wife can come and stay with her husband in US ? That is what the Visa bulletin says. I'm assuming nothing changes drastically on current immigration scene.
In short, is it a bad idea - at least these days - to marry a GC holder ? Of course, another assumption is that the GC holder is not willing to move out of US.

Because I put in random numbers for EADs with notice date Oct 11th (same as mine) and I cannot seem to find a pattern.
