vikramy, I suggest you don't give this thing a blind eye, try to get what is the RFE all about and send the evidence ASAP! you only have 30 days, remember we are all fighting against the system, they will try hard not give us what we have worked for very hard. Don't drop the ball, that's my advice.

One of my friend was in same situation as you are in now.since he droped out from school from second semister he completed 6 courses (18 credit hr),after he worked in H1 for 2 years he againg joined the same school for an MBA program and he managed to transfer some credit hours from previous courses,he enrolled in most of the online courses offered by the school and finished his MS.
Here is what he experienced at the time of Stamping.
1) Why did you left the school from second semister?
He said he got the nice job offer which he can not turn down
2) Why did he go back to school after two years
He said that he needed the MBA at his current working company to move on to better position.
He got his visa after the W2 and pay stubs verified by the counsler (latest 5 stubs)

But My problem is my school does not offer any courses online and my work place is almost 4 hours drive from my school.....
If i enroll back in school through open university and take courses that counts towards my graduation will that help in convincing the Visa officer that I have not abandoned my intent to earn my masters degree....
I cant wait till i complete the remaining courses... any one else to share any ideas or experience...

if you have the stomach for it, get a lawyer and threaten to sue you employer.

First of all you donot need a I-140 copy for Ac21, if you have filed 485 and 180 days have passed.

It does not matter if you are on EAD or H1b. GA DMV has been causing problems lately to everyone including few of my friends with a GC. GA DMV is getting notorius with this and unnecessarily making an issue with renewing and issuing new DL's.
We are already dealing with monster USCIS and now we have to deal with GA DMV too. Why are we made to feel that we are so unwelcome here?

I think COBRA (http://en.wikipedia.org/wiki/Consolidated_Omnibus_Budget_Reconciliation_Act_of_ 1985) applies in your case.
So, you could continue your previous coverage for a certain period of time - usually 18 months.

My lawyer gave me the same choice between applying I94 extension and visiting canada . I decided to travel to canada .
Any way you have choice of applying new H1 and getting I94 extension with the new H1 .

This is interesting. The old AC21 memo had no mention of Ability to Pay for new employer. But Now CIS is looking at A2P issue on AC21. This could be bad news for folks who were planning to freelance via their own companies. People going full time with big corporations will be safe.
Here is my case and am awaiting USCIS response.

I have worked many times, after sending the courier. Just have the documentary proof of payment and fedex receipt. That is SUFFICIENT.
BTW: One tip I have for u guys, is to pay the H1B fees with your personal cheque, and that way, whence the cheque gets cashed by USCIS, you immediately have the receipt and furthermore, USCIS would put your EAC number on the cheque, whilst deposting it, hence u have three benefits, when u pay with your cheque.
- u know when USCIS cashed the cheque
- ur middleman can NOT fool you, since u know, exactly when the app is filed and money collected by USCIS.
- u have the receipt # (which is also ur EAC number) the moment the cheque is deposited.
This is common sense, tactic to keep urself informed and enabled, always.

Check out Fedex tracking number one more time if that was actually delivered on or before Aug 17. If it is your lawyer should have a print-out of that and send it along with your 485 application to USCIS with a yellow sheet mentioning it's a re-submission.

USCIS can not approve cases in July for EB catagory. If uscis have visa numbers then uscis have to accept I-485 petitions.
At the year end we will know if any visa numbers were wasted just because USCIS didn't want to accept the 485 applications. Plus if there are wasted visa numbers than DOS also need to be blamed for making wrong assumption regarding exhaustion of visa numbers in July. Again this is all speculation.

H1B extension was approved for 3 years. I have a couple of questions.
I applied H1B in May and got an RFE. I had travel plans in June and Since I did not have time to respond my RFE, I responded to the RFE after I returned back with the new I-94 card and also mentioned in the RFE to use my new I-94 but they did extend my status with old I-94.
Technically, I should have the new I-94 attached to the H1B extension instead of the old one. What should I do in this situation?

My H1 visa has expired but I have a valid I-797A with my H-1 petition, applied by my employer at the time of extension.
I am travelling to India from Newark, New York via FrankFurt on Lufthansa.
Do I need to have a transit visa ?

Suman, you dont need transit visa. Send an email to the German consulate explaining your position they will confirm back. They are very good at replying to emails.
I went to India thru Frankfurt this October on an expired H1 B Visa and approved I-797 i didnt need a transit visa. I have a pdf document from the German embassy confirming that ppl with approved I-797 going back to the country of origin doesnt need Transit visa.
