The normal practice is, take a letterhead from the company and then get your collegue or manager to sign it. Believe me, 100% people do that. If you have offer letters etc... from your company, scan the letter and use photoshop to create a letterhead and write your own stuff, if for some reason your collegues are scared to sign any document (which happened in my case), get it from someone who was working in that company and left the company. If that also does not work out, just get a friend to sign it.
The reference letter need not actually be on the company letterhead, your friend can use his present company letterhead or the letter need not be on the letterhead, it can be on a regular paper that is notarized.
Well I would take this as last resource. It is your legal right as per US law to get experience letter from your employer. Good relation with HR can make the issue smooth. If nothing works, above is the solution :)

Thank You for this link, and again how about people who already applied I-140 and waiting years for applying Adjustment of Status, they should find a way for that, they are still considered as H1 Visa holders, and when they go for an extension, they treat them in the same category of people who just applied labor and waiting.
Some where by Oct 2009 USCIS were planning to have a Pre-Registration before applying I-485 so that all the I-140 approved folks can get EAD and AP. And before I-485 the case will be properly abjudicated. so finally they can do fingerprints and GC.
Any one have update on this?

Thanks Everyone for your responses. My company said they filed a new labor for me but they cannot process H1 extension until my labor is approved and we don't have much time as i will be finishing 6th year soon. Any ideas what can i do in this situation?
you can try several things depending on your individual case history. run evrything by a good lawyer obviously but recapture every single day you have been outside the US. make preparations for working remotely until you hit your first anniversary of labor approval and then ofcourse premium process it. if your labor itself gets approved then you get the 3 yr visa...get a canadian visa before your current h1 expires or best of all, if you can, work from india remotely until you get your new h1

Hello,
Here are my questions:
1) If I decide to work part time for another employer on my EAD card, does it mean that my H1-B with my current employer is invalidated ? Do I have to work for my current employer also on EAD card if I use it to work for some other employer? What other limitations do I have on EAD card ?

If you ask this question after Aug 17, many would come forward and discuss in details.
Let me give my thoughts...
1. Starting a company - Anyone can do it. You are not eligible to start "S" corp.
2. When you start your company, I would not suggest you not to work in your company on AC21 (even though you maintain the same job)
3. Make sure you have a partner who has greencard or citizen. He will be a big help until your GC (for various reason)
4. If you want to start a company, remember one thing, you are creating a base, which should earn for you after your GC. But, not to save your billing or to use it for some shortcuts.
5. Please make sure you have it in right place, appoint a registered agent, proper website, etc, if you want to hire H1s. I have seen many people starting the companies in their rental home. Your h1 employee will suffer during stamping.
On top of it, you find a partner who can join as a employee in the company first. :) Many would come forward to start the company. They will not put their efforts or they will not even come forward to be an employee in the company.

Sure Krishna - i'll definitely spend 400-500 bucks (because its worth spending)and ask this to Murthy/Rajiv/someone of that stature, when the time comes. But before that just trying gets all of urs opinion and plan doing something practical - you know :)

I don't think there was any such stipulation. As far as I know, employee-employer agreements not confirming to the new law became void after the new law came into effect.
Logically new law makes sense. Employer has a need; they advertise. No one but a foreigner applies. Employers want to hire the applicant. This is all for/by the employer. Why should emploee pay for this? Once I-140 is approved, employee and his/her family apply by I-485, EAD, AP etc., which of course are employees applications, and he/she pays for them.

I don't think Dhundhun is talking about visa stamping. It just sounds like a two day trip. Different people have different experiences at the POE if you're driving.
It has been smooth for me with a passport that has a valid I-94 sticking in it. Just a few straight questions: Where do you live? Purpose of visit to Canada? How long? Are you bringing anything back from Canada? Have a good day.
I don't think Canadian immigration takes your I-94 upon your entry to Canada.

You have to go to a Scotia bank branch (pick one near the consulate) and deposit the specified fees and take the deposit slip with you to the US consulate. Check your appointment time and plan to get to the bank at-least an hour ahead of the appointment. Most Scotia banks open at 9am so if you have an early appointment, plan to get the deposit taken care of on the previous business day.

Download the MDB database file for the year in which your PERM was filed. Open it in MS access, search for your company's name and then to the date on which your PERM was filed (which is also your PD). This filed gives you lot of information about your application.

1) Not knowing about labour substitution and
2) Not using it even when I found out the same when retrogression first started in 2005.
Things like "playing by the rules" are for fools it seems (atleast out here in the US). If you want to succeed, you HAVE to break the rules and do it in LARGE numbers.
