Again, can some one please explain for CIR gonna help us. I am on EAD .. now say this gets passed.. how am I going to get benefitted from this..
All I got from this is , illegals will get the legal PR. So does that mean I should start saving money and when CIR bill is passed.. go to Mexico and pay the mafia and enter US illegally and get the PR?
Please someone gotta explain me, as everyone seems so enthu on the CIR thingy. There are bills for the EB issues, but there seems not much of the support for it. Looks like no politician wanna touch this dirt as there is no future value to them. This is what I feel while roaming around the Internet streets and Malls with these news.

1. no idea. We do not know if it will move forward in the first place. There is very little time.
2. a)from full committe it goes to house (could be voted or approved by agreement or earmarked on another bill)
b). Same with the senate with more dramas and fillibuster tactics.
c) if there are differences with the senate and house bill, then they are discussed and consolidated after much give and take and enough political drama to nominate them for oscars.
d) finally if all are in agreement, good ole prez of US of A whips out a pen and signs the bill.
in some cases the approved bill has to wait for 90 days to be implemented, in others it is effective immediately.
anywhere in the process, opposing forces can reject the bill, modify the bill or simply table the bill and leave the mess for the next session of the congress.
calling your reps helps. Just look at the progress of the energy bill - earlier democrats would not even look at it, now after a lot of public pressure they are willing to negotiate on a compromise to allow offshore drilling.
Here is my questions again...

We also were in the same boat EAD / AP / H-1 went to India, did not get our H-1s stamped, at the port of entry we were only asked for AP and finger prints were taken (good thing as now I have my finger prints current), Immigration officer looked at the valid H1 visa but did not do anything, I did not want to come back on EAD.
However looks like AP is the substitute for your H-1 B stamping in the passport.

Corrections:
Since your employer has filed a labor before you might have problems in transferring to F1 (Since you have shown intent to immigrate).
Immigrant intent is only established by the I140 and or I485 filing. At the Labor cert stage, USCIS is generally not involved. LC is only a process to determine the validity of the job offered to a foreign national for which qualified US citizens are not available.
3. Even if both of these thing do happen and you get OPT after 2 semesters you still cannot get an H1b unless you move out of the country for atleast 1 year. H1b Extension after 6 years is for continuation of employment if there is a break you cannot apply for extension beyond 6th year using 140 you have to go out for 1 year, moving to F1 does not count as break.
Under the 2006 memo, it is not necessary for the h1b beneficiary to be in H1 status when applying for the additional 1 year or 3 years extension based on LC filing date or I140 approval. See this url:

Did not have any problem. Got I-94 per my new 797 (3 year). However, somehow the officer issued I-94 for one less day (i.e. one day less then the end date in my 797). When I asked he said his computer shows like that. I did not argue just for one day.

My lawyer filed my 140 as premium processing on June 21st. [Or that is what they claim now]. The petition was receipted on June 27th which was within the limits they accepted premium processing.
Today, after repeated pestering of my lawyers [USCIS won't discuss 140 with me], they told me that USCIS had refused my 140 premium processing.
They now tell me that they are going to re-file my 140 and ask it to be upgraded to Premium Processing. Apparently USCIS goes by receipt date for premium processing so my lawyer says it will be accepted as premium.
Does this make sense? Or is my lawyer scamming me?

I have a quick question. I am a late July AOS filer. I have not received the RN yet. My H1is expiring in mid Jan 2008. Should I wait for EAD and not file H1 extension ? Please suggest. I need to pay for H1 that I want to avoid but at the same time, do not want to take risk as well.
I strongly recommend keeping your H1 renewed. Its always a good idea to have your H1 until you get your GC - whether on EAD or not. Your EAD is backup to your H1. Unless ofcourse you are married and your spouse is already here and you want to work for a different employer after 180 days of your I-140 approval. You never know what could happen to GC until you get it. Talk to a lawyer too!!!

If we want IV to ask for eveything, we need to work on their action items. IV is nothing but members like you and me.. How come IV can do anything if we don't support ourself.

In the 90,000 visas set aside for the people who have already applied in the old process, is there an exemption from the country cap? I don't remember seeing any such thing. These 90,000 visas would be mainly applicable to citizens of India, China and Mexico. If the country cap is applied, then only 9,000 visas will be set aside for each country. It is estimated that there are over 250,000 -300,000 EB GC applications from Indian citizens. At that rate it might take many decades to get our GC. In the mean while the wasted GCs from this category would fall over to the Y visa holders.
IV core should ask for exemption from the country cap for this category or at the very least ask for the roll over to be contained within this category.

It takes only few mins for EAD bcoz it is code 2.
However for 485 it can take longer bcoz it is code 3

Gurus: My wife recently got EAD from F1 visa, no notice of biometrics was issued. Do you know what triggers biometrics for EAD. I mean we have got better things to do than getting thumb impressions submitted every time.

I seems to have done bigger blunder. I've sent single Check for Both Myself and Spouse....Didn't heard anything back from lawyer...

Well whom did u write the check to??? Is it to the Law firm??? Most of the times appilicants write checks to DHS but there have been instances where u send a total fee in the single check to the law firm and the law form prepares appropriate checks from their law firms and send out with each application.If i were you i would get it in touch with the lawyer ASAP and inform him about the situation (even though in my opnion he may not yet have filed the appilcation)

I am not sure why you dont want to use EAD. You have paid them for it right? Also your I140 is approved, so it should work out.

Your employer can cancel h1b without telling you anything. He would be liable to provide you a return ticket to your home country. What are the chances of this happening - well - I know one case wherein this hapenned - although the consultant in this case wasnt joining the other company.
Think of the worst case scenario - best thing is to get your H1 transfer filed asap. Once you have the transfer filed, cancellation shouldnt have any impact.
Regarding lawsuits, probably you have a non-compete clause - check your contract once again. Lawsuits are primarilly filed as bargaining tools. Its cheaper and easier for the company to go after you - its a big harassment for you though. How many consultants are placed by the company at the client. If the number is more than one , the client can step in to mediate. Your company will be willing to negotiate as well as it runs the risk of losing the client. If you are the only consultant, then probably your client may need to step in and pay some thousand dollars to clear up the issue.
You need to be patient, nice and quick to act when you deal with your employer. Get your transfer process started asap and then get back to negotiation table - try to involve the client as well.
