Anybody who converted from H4 to H1?
I have been to Vancouver 2 times and no problem. I just went in August last year the process was smooth as ever, actually I prefer Canada to Indian Stamping. Make sure you have Pay stubs, an Employment letter. And all the visa papers.
No US degree.
Working for Same employer for both the Stampings.

After reading so much into AC21 i'm still missing something.
Please consider this scenario.
I'm in good terms with the original GC sponsoring employer and have an approved I140. I want to switch to an entirely diff job(or may be even unemployed) using EAD. I can produce an offer letter (at the time of adjudication or for RFE) saying this company (or if they go out of business a diff company) will hire me in the same occupation once the GC is approved. In that case will AC21 come into play? So do i need to worry about doing a same/similar occupation while on EAD if i have a future job offer?
I remember reading unitednation doing something similar.

It is all about intent. You have to convince the IO, that you planned to do that from the start. IF you were on a 60K job, then got EAD and moved into a much more lucrative field and started earning 120K, you just might have a tough time convincing the IO that you planned to go back to your 60K job once you got your green card. Remember this is EB immigration and job specific. If you change jobs, it is better to stick to the same/similar job classification. Once you do this, I am sure you will have a little more leeway with the job salary etc.
That is my take on things. This is not legal advise.

I have seen too many posts that deride murthy firm and even AILA. Don't know what she did against IV to deserve this. I hope this is not due to IVs pride in itself. I know there are many bad lawyers, but never heard that murthy is a bad one. Her letters may not end up getting any results, but she is atleast trying to do something, unlike many other law firms.

I will recommend you to send PM to UnitedNation. Since he has expertise/knowledge on I-140 process with 3 year degree programe from Indian subcontinents. He has helped several people at immigrationportal.com. He is active in this form as well. More he can guide you without you waiting on other or wasting much time. Hope this helps.

This bill will benifit Univ Recruitement of Lecturers and scientists, with PhD qualifications and in some research areas also in private sector (If any left here in US,---during Obama tenure and after Out sourciing the research also to India).
The underlying condition is that Job should require a PhD....
Given the economy, one can easily imagine which employer would dare to say that a particular job requires PhD and stand the test of DOL

I may be wrong. But as for as I know, he has to apply for extension again, since I-94 he has on the extension approval has a different one than he has one right now.
That is the reason Lawyers say don't travel when your H1 is under processing, He should have showed approved H1 notice and got the I-94 beyond this date.

Based on various postings such as , murthy.com, none of the July 2007 filers to TSC has received I-140 approvals. The exceptions are people with PD before 2004.

Hi I got a job offer from TCS America. Not a great company to work with i guess but given the job market i want to be little conservative.
In the past i heard some bad things about TCS practices and benefits (medical and so). I am not sure if they stay the same or anything has changed. I also heard that they ask for 3 months notice if you choose to leave.
Could please any of you familiar with TCS and their benefits please pass on your comments. I am specially interested to know how professional they are and how their medical insurance work. (I am told the medical insurance is very bad that it doesn't cover much .. is that true?)

Yes, you can. You can mail the documents to any consulate. But If it is more than one year of expiration, then you have to go in person to get the renewed passport.

I am also NSC->CSC->NSC July 2007 filer. I just came back from Infopass appt. They took my and my wife's receipt notices and went inside. She checked everything and came back. She told me that our FBI name checks and Biometric checks are completed and everything is clear. It is waiting to be assigned to an adjudicating officer. She said that you can hear from them anytime. There is nothing else we can do now. Just need to wait......

We had seen worst of the GC process:
labor got remanded back to state then send back to DOL again and got approve.
FBI name check stuck for around 2 years,
485 filling during pregnancy,
Fingerprinting notice sent wrong address,
2 RFEs for 485 (one for TB test one to get current employment letter)
and finally retrogression!
I was hopeful when the dates became current that this will be all over soon but logged in today on immigration voice and got the shocking news about visa number for EB are now unavailable. Thought that we were unlucky again.
But then checked the status online on USCIS and there it was following message �
�Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered.
On July 2, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.�

I know one case where the dependednt was in India when her AOS got approved. She came back on AP without any issues. But the only thing is she was there just for 5 weeks., and this happened last November.
Her husband talked to some lawers to see the possibility of mailing her card to India, but he was told mailing hte card is illegal.

Can a mailing receipt be used as proof that the transfer documents were sent to USCIS?
Nope. It is my understanding that you need atleast the Receipt number before you can start working for a new company.

vikramy, do you know what the RFE is about ? Medical Exams? Are you the main applicant? usually the main applicant gets things first. But you know, this is USCIS expect the unexpected. However you only have 30 days to respond to a RFE so make sure immigration gets it. and think positive, you'll get your green card!
