    Thank you all for responding to my query. Here is the more info regarding my case:

    1) I switched to another company on EAD.
    2) I worked for GC sponsoring company for over 2.5 years after filing I-485.
    3) My current job title and responsibilities are almost same as earlier one.

    Today I got a text message from USCIS with an RFE. I am still waiting for the letter in the mail.

    Now:
    1) What are all the documentation I need from my new (Current) employer apart from Employment Verification letter (EVL)?

    2) Can i continue to work for the current employer while my case is in suspended state?

    First of all RELAX!
    It's become quite common to get RFEs for even simple or straightforward H1B extention or transfer cases..
    Secondly this RFE is probably similar to many others where they ask anywhere from 6 -12 different questions and mainly try to validate the existance of company
    that it has employees and is paying them on time
    That you have correct qualifications..
    Once you get RFE, and send reply, if it's premium case, approval is sent within 2-3 weeks at the max..

    My employer has decided to concurrently file for my I-140 and I-485 in EB2 category. The application will be submitted to USCIS by Aug 1.
    This has turned out to be a nightmare for me. I am on H1B right now and plan to get married to an F1 holder in Jan 2008 in India. I am worried that my to-be wife will not be able to return to the US on F1 after we get married in India. (She is not included in the I-140 and I-485 application right now.)

    Has anyone faced this problem? What are my options?
    I was able to come up with the following options. Any comments on these?

    Should we get married (like today!) and include her in the I-140 and I-485 as a co applicant. Chances are that the lawyers will not be able to process the changes in the application in the given time frame.

    Should I abandon the I-140 and I-485 application and continue on H1B.

    Should we get married in US and never travel to India while she is on F1. Later she can convert to H1B and then we can travel?

    Think India, Think Gandhi, Says Senator Harry Reid

    Senate Majority Leader Harry Reid, Nevada Democrat, who played a hand in the first ever instance when a Hindu prayer opened the US Senate, has said "if people have any misunderstanding about Indians and Hindus, all they have to do is think of Gandhi."

    Reid facilitated Hindu chaplain Rajan Zed of the Indian Association of Northern Nevada, to deliver the first-ever Hindu prayer to open the US Senate on Thursday.

    Reid, taking to the Senate floor, immediately after Zed delivered the opening prayer as a guest chaplain, which was disrupted as he was about to begin by some Christian fundamentalists who were ejected soon after they screamed, 'Lord Jesus, protect us from this abomination,' said, "Here's a man (Gandhi) who changed the world, a man who believed in peace."

    The Senator said that Zed had ended his prayer with the words, peace, peace, peace. "That was the prayer. If there were ever a time with this international war on terror that we're fighting now where people have to understand how important peace is, think of Gandhi, a man who gave his life for peace."

    "A tiny, little man in physical stature, but a giant in morality," he said, and pointed out that "Gandhi is the man (the late civil rights leader) Martin Luther King followed."

    Reid said that Rev King's "nonviolence was based on the teachings of Gandhi. We had the civil rights movement led by this man small in stature. But he was a giant of a man morally just as Gandhi was."

    He said, "I think it speaks well of our country that someone representing the faith of about a billion people comes here and can speak in communication with our heavenly father regarding peace. I am grateful that he's here. I'm thankful that he was able to offer this prayer of peace in the United States Capitol."

    "And I say to everyone concerned, think of Gandhi. If you have a problem in the world, think of what this great man has done to bring about peace and nonviolence to this troubled world."

    Earlier, in his remarks, after introducing Zed and spelling out his credentials, Reid reminisced about his "long standing association with the Indian community."

    "I went to college in Logan, Utah, Utah State University," he said, and described it as "a cold, cold place. Brigham Young, when he sent the people to colonise the West, had people come back from Cache County to tell him it couldn't be settled because it froze there every month of the year."

    Reid said, "The first two years, I lived off campus. I was married and I would drive up that hill to the campus, and there walking every day were students. They were Indians. Coming to the United States to study from India. Utah State specialised in engineering and agriculture, and these young men came from India to study at Utah State University, and I would give them rides."

    "I did that for two years. Put as many in the car as would fit and when it came time to graduate, one of them came to me and said, 'Would you and Mrs Reid stay over for a day, and we'd like to do a traditional Indian feast for you.'"

    Reid, who's originally from a small Nevada city called Searchlight, said, "I didn't know what they were talking about. But we had that traditional Indian feast, and many of them were dressed similar to Mr Zed here, and that was an eye-opener for me. And, they had all this Indian food. I'm a guy from Searchlight who ate beans and rice, potatoes, and when we were lucky some steak my mother used to pound so it would be tender and we could eat it."

    The lawmaker said Indian food to him at the time "was unusual," but spoke of how much "we enjoyed it. It was a lot of fun. They gave us gifts when it was over. It was all a feast. It was traditional Indian food."

    Reid said that although he could not remember all the gifts he was given that evening, "I do remember one thing they gave me. It is here in my office in the Capitol. That was many, many years ago, we've had had children since then and lots of grandchildren. But this is a little statue of Gandhi, hand carved. It is done so well. His staff, you can pull it out of his hand-- it's done really well."

    "And, I've protected and saved that all these years, and it's in my office and I've always had it there," he said, and then went on to say that the reason he mentioned this was that if people had any misperceptions of Indians and Hindus, all they had to do was think of Gandhi -- a man who has changed the world.

    I don't see any problem in taking promotion if company is willing to pursue all the future process indicating the old title and job description. In most cases company do that.

    Hi,

    I travelled outside USA last year and entered using Advance parole. When I entered USA, my I-94 was stamped with one year time. Now, my I-94 is expiring.

    So, my question is will I be out of status if my I-94 expire? I have pending I-485 and used Advance parole to enter USA. This question may have been answered before but when I asked this question to my lawyer, he said I need to renew my I-94. So, now I am kind of confused whether I really need to renew my I-94 or I am good because my I-485 is pending.

    I will be in similar situation in Apr 2009. I asked my lawyer. He said that dont worry. It will be extended. I have to remind him next week to extend the I-94.

    U send mails abt I-140. U'r mail goes straight to bin.
    Calls go unanswered. :mad:

    I don't have reciept# or anything related to I-140. Any solution folks ?

    I know a few good friends (GC or citizens) who will be willing to do anything to help me - they were once in the same boat and/or have seen their close friends suffer with pathetic priority dates, layoffs etc.

    However, lets face it - we can't expect active participation from them - in terms of logging into IV and looking at action items. What we can expect is prompt action if an IV member (like you or me) approaches them with very specific action items. We have to do the groundwork - for example, if the action item is to send a letter to your local senator, we have to take our friends' zipcodes, find the senators and let them know the specifics - where to send, what to send.

    I am all for this. I am sure everyone has a few friends who recently got their GC, or received it many years ago in the good old times and are now citizens, or relatives in another state.

    We want them to work beyond logging into IV and reading posts. Our forums are just a tool and not the end.

    The real work that IV does is advocacy effort. We want interested people to join us and get active politically. It does not need to be thousands or hundreds of such members. A few committed members who have been committed to IV all throughout their GC journey will do. If we have a group of such members, we will be communicating with them directly on specific agenda items.

    From what I could understand, there is no mention of EB1 and EB2 at all. It generally covers all canidates who have obtained a Graduate degree in STEM from an American University. So it should benefit EB3 applicants who have a MS in STEM from an US varsity.


    Even if there is no direct benefit, taking masters folks out of the quota will cause spillover numbers to come into EB-3.

    Hello All,

    NSC processing times report dated 6/15/06 is available on AILA website. Per this report, NSC is processing EB3 I-140 applications dated 1/16/06. For the last (3) months, it was 2/20/06. The processing time has started going in the wrong direction for this category. Does anyone here have an idea as to what could have caused this change?

    My attorney was swearing that you don't need employment letter. He was saying that he applied numerous I-485s recently without employment letter. He says that employment letter was required long ago, when the gap between I-140 and I-485 was many years, so INS wanted to verify that you are still with current employer and that employer still intends to sponsor you GC. Today you apply 140 almost together with 485, of course it means that the company is willing to sponsor you, so the letter doesn't make much sense.

    So... according to my attorney you should be fine.

    (although I personally insisted on inclusion of my employment letter and he included mine reasoning that it will do no harm).

    You are right for concurrently filed I-140 & i-485 most lawyers do not include it. BUT it is listed as initial evidence for i-485. You did the right thing by insisting it be included, at a time like this, it is not worth the risk. I anticipate that if they have 10s of thousands of applications USCIS will try to reject as many packages as possible (closer to Aug 17th). This will mean less to adjudicate. NOONE esp EB3 should miss this opportunity!

    I am sure in a forum like this you will not be able to divulge all the the details and all the feedback you get is based on someone's experience with the little they have read. There is more to a situation being just black and white and only the professionals can navigate well through the grey areas. This is your career and there is nothing more importnat than that. Talk to an attorney or maybe get an attorney's advise from this website itself.
