However, the IO lady at Infopass tried looking up my approved I-140 and it's not there. She said they have already closed it. I was too stunned by all these developments. How could they close I-140 while I-485 is still pending approval. She took my case to her boss who also said they are helpless. My A# does not pull up my approved I-140. And like someone else suggested - we might have to call them up for attaching our biometrics too. This system is so screwed up. If we got to do everything, they might as well handover the entire process to us.

My Employer applied LC in Dec got RFE in last week ,but
stating the reason:
Please provide documents such as position descriptions, the percentage of time spent on the various duties, organizational charts, and payroll records demonstarting that the qualifying experience gained by the alien while working for the employer, including as a contract employee, was ina position not substantially, i.e., not requiring performance of the same job duties more than 50 percent of the time to the position for which certification is being sought, and/or documents demonstarting that it is no longer feasible to train a worker to qualify for the position.
Please advice me what should I reply ? How serious is the RFE ?

RFE is always serious. Dont take it lightly as they might deny approval if you dont respond or the answer is not satisfactory. Your RFE seems like for your experience though I am not very clear. What your attorney saying. Whats your GC category and how much experience it requires. What is your experience. Provide all the details and people would be able to answer your questions.

Thanks . I forgot about the payslip. I also included a letter from Employer stating that I am a full time employee going on vacation for X days and a notarized copy of my H1 petition (797).
However, I did not book (and so did not send) my air tickets before visa.
Even without going through the agent you will possibly get it in about 2 weeks or less by mail ...

This means you have to get another medical report, photos, etc. Is your lawyer charging you for second filing?
The whole idea of refiling is going to be a big mess for sure : In case if your file is rejected becoz of unfortunate reasons or no receipt generated till sept ending then obviously you can refile with your proof of filing no worries even if dates retrogress saying there was an issue on USCIS side.Applying again wont help in anyways becoz files u send it now will not opened even till October. I dont know which attorneys are calling this for .
To have better clarify please kindly enquire multiple times before starting yourself on this. My 2 cents. There is no rule that suggests you need to apply just becoz one didnt get reciepts. I am too very much concerned with refiling but after looking thorugh various issues and talking with my attorneys its clear that refiling is going to invite much of issues which are uncalled for .

based from past experience, my guess is eb3 will be september 1,2008. this is just a guess. my priority date is september 27,2005 and i guess my priority date will not yet be reached next month. last month i predicted a six months advance but it came out only 4 months. this is my prediction, an unselfish one but a realistic estimate and gut feeling. remember my priority date is sept. 27,2005. still falls short next month.

My son is a student at UGA starting fall 2008.You can get in state tuition from both colleges(at least we did).After you apply and you are accepted you have to apply for a Waiver.You'll be considered international student with a Waiver for in state tuition.You'll get help from Financial Office for this.

I m not sure why you need to mention about pending 140 when you are applying for H1 extension with approved 140 .
I m not sure you get 1 year or 3 years , but just apply your H1 extension with approved 140 and forget about pending 140

my comment is with respect to the bit about us getting justice!! melodrama will not get us anywhere. IMHO there is no injustice being meted out here. Our situation is a mix of a broken system and, supply vs demand.
also, please keep in mind that the core group, after working with QGA and various members from both parties, has a very good understanding of the way the system works. you have to change this from within. marching and screaming and hollering is going to get us no where.
as for help, I have seen many memebers offering to help. when someone from the core group says that all the help we need now, is money and more members, why can we all not just HELP by contributing and getting more people to join??

The name calling has happened to me and has happened to my friends. I had never heard the name Macaca.
Every Indian in India has a Macaca like name. Based on this, I have no reason to complain about George Allen. I don't see why any Indian Indian should complain about it.
Name calling is not acceptable in America and Sidarth is an American citizen. So it is a problem in America specially if it is on camera.

This is now tricky and will require input from senior members. I believe that she will have to maintain the status she was in at the time her husabnd's GC was approved. If she was on H1 or converted to EAD based on H1 then she has to continue working and maintain proper records. She cannot convert to H4 as husband's GC is approved.

Hi Guys, If any one else faced a similar situation.
My wife gave her road test on April 04/05/08 and passed the test but DMV failed to issue her driving license as they could not find her I94 in list provided by USCIS for clearance for issuance of Driving License and the officer who took her road test explained to us that they sent the query to USCIS and asked us come back in 15 days, and when we went there for the second time a different office but same story and this is going on since then, I called USCIS today ( the number provided by DMV for USCIS ) to ask them if they have my wife's ending application for clearence they say that don't interfere into driving license issues and we have deal with state of Georgia.
DMV office is not accepting any phone calls to update us with he status of the query, so we have go there wait for 2 hours and get the same response back.
My wife is currently on H1 valid until Oct 2010.

U will come across rude IO, VO, DMV etc... officers more often in coming days. You may not 'individuallly' be able to counter them because their superiors may be sympathetic towards them.
Be very polite when they turn rude to you. Talk to them well, and politely ask for their name, and describe your incident to the complaints cell.
If this pattern is repeating and is happening to everyone, then collective action can be taken and will be effective.

More times than not common sense goes missing among the highly educated. The trouble is, you mix that fact with added politics, and now you have a complete and utter mess. They are dumping money in businesses without making sure of returns. This economy is not going anywhere.... they can fool trusting citizens, but not people with common sense.
