I heard that USCIS will request NVC to transfer the file to USCIS.
I thought that it may delay the process if it goes to the consulate office, abroad. That was the reason why I wrote a leter to NVC, just to keep the case at NVC instead of moving it to Consulate, abroad.
I talked to NVC few times. Some representatives said that they need a written letter from me, so that they can retain the case at NVC, but some representatives said that they need the request from USCIS to stop the CP to move to consulate, abroad. I am not sure which one is correct.
I am waiting for the automatic response system to get updated with my request. I will see whether NVC considers my written request or avoids and process the case send to consulate, abroad.
Any ideas or suggestions?

I am not sure how far that is true, but even our company attorney told me to wait untill the current visa expires before going for stamping. The reason she told me was that, inorder to issue a new visa in the PP they would have to cancel the old visa.

Yes, most people get VISA stamp bc of interntaional travel not bc it looks good on ur passport.
why do you want to do that - unless you have international travel plans ahead. even if so - the best bet would be getting it done in india. i dont see that many people were successful in obtaining visa from canada, who dont have masters from USA. my2c.

GPS, u can try Palmgrove; rates r reasonable and is walkable to the consulate. anybody will show direction from there to consulate & its very easy. turn they also offer pretty decent southie food. hmm...what a pleasure to not get caught in the autorickshaw scene of chennai.. :-)

Hi all,
Greetings! I need to visit Canada for a week begining 7/27/07. My lawyer will be mailing my I-485 mostly this monday. He recommonds not to travel out side US until we get receipt notice. My Canada trip is very important. AS per my knowledge we will not get new I-94 as long as we are traveling for less than 30 days to Canada. Any thoughts about the impact of traveling to Canada before we get receipt notice for I-485?

To request advance parole, you must file Form I-131, Application for Travel Document, with the appropriate fee at the USCIS office where you applied for adjustment of status.

My case is NSC-CSC-NSC. i-485 applied in NSC in July 07, transferred to CSC for data entry, transferred back to NSC in 2007. Welcome email received today.

Reason for denial was because of experience affidavits...
Did they allow you to file MTR? Have you seen your denial notice? On my denial notice, they mentioned that appeal can be made to AAO office....no word about MTR..

No � I do not think so. As far as I know 485 is based on your labor certification � which was approved long time ago. By this time it is "yours". Collect your documents � you should have your LC somewhere � (There was some topic earlier talking about LC substitution � where the employer could use �your� LC and hire somebody for your position � In this case your 485 could have problems - probably this will not be the case this time + I do not know that they can do this anymore � some change was implemented in the law)
2. In that case how will future EADs and APs approved, as they are done based on pending 485.
EAD and AP is based on your PENDING 485 - renewing it as far as I know does not require to submit evidence about employment (might be wrong here � I�ve seen some new EAD application forms where was a field like this � not sure about this)
3. Is the employer needed to withdraw these petitions like 140, 485.
No, however if requested they will respond that you are no longer employed.
4. If I join a new employer with EAD, then will they have to do my GC again from scratch, or should I just wait till dates become current. If so, then how will I get EAD extensions if 485 is withdrawn(let us say).

I dont see a big problem , yes there is a problem because you lost the job . Here is my adivce there are 2 things you should be most woried about , your financial condition and health insurance(very important as your wife is pregnant).
About your job and your status , you are ok as long as you find a new job and as your are open all over US , you can find one easily.
As far as I know, you can continue health coverage under rule called COBRA. Call and ask your HR/insurance company or just google it. Try to find a new job using H1 transfer or EAD.
EAD is only a backup for most of us if we are working on H1B. But you never know when you may have to use it due to layoff, firing or any other unfortunate event. It is more likely to happen due to current state of economy. CIS allows us to continue working on EAD after 180 days of filling 485 under AC21 rule.
However there are some unfortunate incidents going on where IO wrongfully denied 485 petitions when a person changed jobs using AC-21. I urge you to take part in IV AC-21 letters campaign which will help you and all of us to survive any unfortunate, unforseen job loss due to current downturn in economy. It is actully very easy, just print 4 pages and mail it thru' USPS. Won't even cost you $2. If you are going to visit Chennai for visa interview, then your best bet would be to ask the consulate officer about local bargains on hotels.
Also, look for autorickshaw drivers who are willing to share their driver seat with you while transporting others in the back. You could save tonnes of money right there!
