Really surprised but pleased to say our green card got approved today !

485 RD � Mar 2004
EB3 - India
We had seen worst of the GC process:
labor got remanded back to state then send back to DOL again and got approve.
FBI name check stuck for around 2 years,
485 filling during pregnancy,
Fingerprinting notice sent wrong address,
2 RFEs for 485 (one for TB test one to get current employment letter)
and finally retrogression!
I was hopeful when the dates became current that this will be all over soon but logged in today on immigration voice and got the shocking news about visa number for EB are now unavailable. Thought that we were unlucky again.
But then checked the status online on USCIS and there it was following message �
�Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Card production ordered.
On July 2, 2007, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.�
Having gone through the worst, I will always support IV and their effort to get justice to all of you. I pray for all of you to get GCs soon.

Does it mean that the numbers were available today? If so, How can they not accept 485 applications?

NSC is taking almost an year to process 140s .. I totally understand your situation ... There is a sliver of hope though I read somewhere that 140s with older priority dates are being adjudicated faster than the ones with newer priorirty dates...

You need to say "Yes" only if your visa is expired in past 12 months. In your case you need to answer it as "No".

We called USCIS to ask what's going on there. The representative told us she can only see the same info as we see, which is the I-140 case is still processing. She can not find the approval message, which we found by using the same receipt number 1 and 1/2 years ago. It's really sad. What should we do?

If there was an RFE, the online status will not be updated even after the approval. So, no need to worry about it.
How ever, in your case, there was no RFE. So, this message could be a glitch in their online system. If you want to make sure its still approved, you can possibly call the service center mentioned on your approval notice and clarify it with them.

Go to Local office of USCIS and get the temp. EAD. Eventhough the law has changed now, they can still issue on a emergency case. Otherwise you have to take a break on your employment till you get a green card. Talk to USCIS and ask for expedited processing based on extreme hardship. It also works.

I got back from Can on 7/22. I didn't know at the time, but checks were cashed on the 16th (I left on the 19th) and Notice date was apparently the 18th. Had no idea of all this till 2 days ago. So it was in the comp when I met the airport IO and they said nothing about it either.

IV tool to find the number in the queue is in much demand. When tool was provided in the Donor forum everyone was looking for the actual FOIA numbers. Now when real numbers FOIA/USCIS website are out people are looking for the tool : )

AustinGC, congrats on your approval for 3 years.
It shouldn't matter as the last I-94 issued to you (either at POE or from CIS) will be your current I-94.
Btw when did you apply for your extension and how long did they take to come back with the RFE ? Also how many days did they provide to respond to the RFE ?

I need to know answer for your question as well. My understanding is that EAD will be activated only when you submit I-9 form. getting SSN using EAD doesn't take one to "Adjustment of status pending" status.
Also, as you know , As soon as a H4 holder starts using EAD then H4 becomes invalid. As long as the primary is in valid H1B status, the dependent can fall back to H4 status even if 485 is denied.
Gurus, Please correct me if I am wrong.

these numbers dont include the cases for which they are awaiting action from the individuals (thats what it says on the website)...so my guess they must have sent RFE's for the rest..;-)..
also .. i think they put out some numbers to get the monkey off their back....

"The Today's Backlog column reflects the additional cases which USCIS will need to complete - over and above our current production rates - before the end of September 2009 in order to meet our processing time goals for the end of this fiscal year."
For I-485, Today's backlog column is 234,043. This # is the one they need to complete before Sep 2009 in addition to their existing production rates.
Total goal for FY 2009 = 234,043 plus the number based on existing production rates.
This is just a piece of a puzzle and doesn't give any insight at all. These statistics are more for themselves than for the real customers like us....These are just to satisfy/justify that they are doing their job!

I e-filed for EAD renewal...I got finger print notice also with Code 2.
Can someone point out to some website or proof that FP notice is generated when you e-file. My lawyer says no. I don't want to argue without proof.

I am going to Calgary, Canada next week for my H-1B Visa Stamping - I am planning for 4 days of stay as I am unsure of the exact timelines as to when I will be getting my passport.
Curious on whether they mail the passport to the hotel or we can go collect the passport in Canada?
I will keep you posted once I am done there!

OR

That may be but even if the discussion starts in July, it may very well take rest of the year to get through congress if it ever does. We have seen this bill sink once and there is no gurantee that it'll make it next time around.
But I certainly hope that something is done sooner than later. If it happens before July, that's even better. We then will just get less time to organize our big celebration party. :)

Just wanted to add my voice to this debate on H4 validity when H1 is transferred. If the H4 is still valid and I-94 is not expired or expiring at the time of the transfer, it is not necessary to file I-539 to extend H4 at that time. When I moved from one employer to another in 2003, I did not file an extension for my family's H4 until their I-94 was expiring in 2005 when I filed I-539 and got an extension until the end of my H1 in 2006.
However, some lawyer advise that you should file I-539 for your family at the time of moving to another employer just so you do not forget to extend their stay at a later date.
So, to the OP, your family's H4 is okay but do not forget to file an I-539 when their I-94 is expiring.

It is called soft LUD, which happens most of times, when there is no real change in the wording inside that link but still you can see a new date. It may happen sometimes when they reindex or restructure or something in their file/database system. An LUD does not always carry description change in your case/file. I hope this helps.
