I e-filed for my wife's EAD renewal on april 21st at TSC. Till now no replies and we had the fingerprinting done on May 7th 2008. We requested for expedite and the current EAD is expiring today(Augst 15th 2008). I saw in the earlier reply, that I can go to local USCIS office and get a temp EAD. Can you please confirm whether it is possible and has anyone got that?

Let's say I switch to another employer using AC21 while waiting for I-485 approval. Then, I-485 is denied due to a simple reason like insufficient funds. Do I have to go through the GC process all over again, or can I just fix the problem and re-file I-485 using the old priority date?

If you are using AC21 option, and if you are on EAD and have abandoned your H1, then if your 485 gets rejected then you are out of status and you have to go back.
If you use AC21 option and if you are on H1B, then if your 485 gets rejected, then you can stay on H1 until the H1 expires and in the meantime, you can file a motion to re-open your 485 case and take it to appeals and so on.
EAD use will give you more options and more access to good jobs out there because the employer doesnt have to sponsor you for anything. But it will give you no backup if your 485 is rejected.
H1 use will give you backup if your 485 is rejected and will give you opportunity to stay back on H1 and appeal the 485 rejection. But it will keep some good jobs off-limits to you because many good jobs require work authorization. (EAD, GC, Citizenship).

Was your FP appointment a "Code 3"? I managed to get a infopass appointment on Nov 14th(more than 90 days from receipt date) just to be on the safe side. Lets see what happens.
I think adults (14 and above) have Code 3 and children have Code 2. Anyway, I have a feeling that they are processing by receipt dates.

If your H1B has applied for COS then advisable not to leave the country, else (if it�s for Consular Processing) then of course I-94 won�t be there.
I wish and hope (as filed with premium processing) you will get your H1B before your travelling plans.

That's true. Only citizens of USA can have political views and can express their views. H1B and H4 holders expressing views might not be legal.
As I understand H1B and H4 holders can not influence politics. Hope that USCIS is not monitoring this thread.

almost three years ago....so let me share my experience.
The USCIS will not accept any birth certificates issued by the Indian Embassy in DC. So, please don't spend time, money and effort on this...
If you have a birth certificate with your parents (i.e., if they registered your birth with the appropriate municipal authorities), then arrange to have that sent to you.
If your birth was not registered, then you have to get a certificate to that effect by the municipality (saying something to the effect that a search was done for your birth records...but not found). Then, your parents will have to swear an affidavit...I can give you more details later, if you would like.
But definitely, the USCIS will not accept anything from the embassy for an I-485 application...

I am going to Calgary, Canada next week for my H-1B Visa Stamping - I am planning for 4 days of stay as I am unsure of the exact timelines as to when I will be getting my passport.
Curious on whether they mail the passport to the hotel or we can go collect the passport in Canada?
I will keep you posted once I am done there!

I understand your frustration. My PD became current after years of wait and I was very excited and hopeful that at last this GC jorney will be over but to my greatest disappointment my application wasn't approved for months and finally PD became U. I know how it feels when PDs bounce around like a soccer ball but despite that I was very happy for my Indian friends whose PD jumped 3 years in 2 months only to go back to 2003 again. :(
We have all seen this PD back and forth drama for years now and what we need to do is to stick together in difficult times and work towards the common goal (which I think is 5882 at this time). There is a legislation introduced to get rid of the coutry cap also but it's not supported by everyone in IV as you can imagine.
Sorry, If I sounded that way, I understand that nobody is having honeymoon here, but EB-3 2005 is better than EB3-2001 and EB-2 Current is better than EB2-2003. In a situation where Congress in not buzzing from it's stand of 'No New Green Cards' for anybody. We have educated them enough that they are not new Green Cards, rather the truth it they know it all, they know the issue more than most of us do, but it's just they pretend to be ignorant. In this scenario I would ask them for atleast a fair system, if they want to keep everything else unchanged..

It's always gonna be rocky unless we get the visas that belong to us from those lower skilled EB-3 ROW people who didn't even go to IIT. I say we should go full speed with the 5921!

My LC was filed just 3 days before 365 days prior to my 6th year end - I tried hard to get that done - now ironically I feel it would have been better otherwise :)
My lawyer told me now I will not be eligible for PP as I can get 1 year h1b extension based on LC filed 365 days prior to h1 expiry
