house needs to pass it, then give it to senate. It needs to pass there also (last year the Comprehensive Immigration Reform started in Senate and died right there). If whats passed in senate is not exactly same as what was passed in the house (ie. they add/delete stuff as its debated) then it goes to a committee where they reconcile everything. Once that is ok, it goes to the president for voting. the president can sign it or veto it and ask for changes. For something like this he will typically sign. So its upto the house and the senate... we are in the very first stage right now and there is a long way to go....
And in my opinion, due to great lobbying by IV and other proponents, these Bills are being considered in the House..at least introduced. While I think it is very very difficult for these to see any traction atall (This is an election yr - c'mon), it will serve as a great eyeopener and awareness campaign for the law makers, and will bear fruit once teh election dust settles. The only issue then is that we will again by tagged together with the Undocumented Folks...so there a catch 22.

How do I postpone the FP cause I will be out of time on that day?
One of my friends went for his fingerprint appointment a few days earlier than the scheduled date. He had no problems at the USCIS office, so I guess you just go there anyday you are free and you should be all set.

Thanks texcan. My Employer already charges me a Grand/Month. So, there is no question about split ups...but I'll do some searches on state insurance board.
By the way iam in TN state...If you know any place to start looking, I'd welcome your suggestion.

While filling DS-156 form for F1 (student) visa, my "fiancee" have clearly specified that, she has her "fiance" is in USA and working. (there is a specific column for that).
In fact, I'm the one, who sponsored her studies. My "fiancee" is my second cousin. While bringing her into USA, I have clearly mentioned to POE (Port of entry) officer, that she is my cousin and got her into Resident/Citizen line for immigration.
Where is the question of fraud. When every information is clearly mentioned in the application while applying for F1 visa.
F1 is a non-immigrant visa, even H1-B is a non-immigrant visa. US systems allows to convert F1 into H1-B upon completion of studies or allows to be on CPT and OPT for a total of 12 and 29 months respectively.
Later, there is a special H1-B quota using which Master's student can apply for working visa (H1-B). Which is single intent visa and allows to apply for Green Card (GC).
Every thing is straight forward and USA systems allows it.
I still don't understand why people fear and when no mistake is committed.
Does not this called a loopwhole and systems is allowing fraud?.
What is fraud and what is not; when system is allowing.

Hi, I'm a Georgia (Fulton County) high school senior applying for college soon for the fall 2008 semester.
My family is on the H series visa and has been for the past 7 years. My father has filed for I-485 in August of this year, but it is still pending. Our priority date is somewhere late 2004, september I think.
Since I'm unsure whether I'm gonna be an eligible non-citizen (green card) for financial aid by the time I apply, would Georgia laws require I pay out of state or is there any chance of me getting in state?
We have lived in Georgia since July 2006.
Any help would be appreciated.. thank you..

My son was in a similar situation during Fall 2007 when my application under I-140 was under process. You do not qualify to file for FAFSA ( Federal Aid form) as the basic criteria is to have either a GC or Citizenship. I will have to shell out his complete Tuition for the whole year. Our application for AOS is also filed on July 02 and EAD and AP for the whole family is filed. As far as California UC system goes he is considered to be a resident student if he stayed in California for more than one year which he did as we have been residents of California for more than five years now. Google FAFSA (http://www.fafsa.ed.gov/) and it will take you to their website where in you could find the relevant info. I guess every state has it's own criterion for eligibility to be considered for resident tuition fees. My son's education proved to be a big crunch on our finances in view of the above circumstances and he can not work till he gets his EAD. Once he gets his EAD he could take some on campus jobs.
I hope this will help you. But if you guys are lucky you might get your GC in a year's time. Do inform them about your pending GC process, it might help.

It is employer's choice and decision whether to file labor or not. Employee does not have any say or input on this.
Having said that if employer claims that labor was filed for you as beneficiary, you can request for case#. It is upto the employer if they want to share case# with the employee or not.
As a practical matter, employer should be willing such information with employee. Again, thats on the moral/ethical ground, not on legal ground.

It was bad that there were no protest when they started rejecting EB3 other workers except the case that AILA expressed some concern. That was made as precedent.
at this point they have not followed so many things in their regulation (act on a revised bulletin, reject EB3-Other-Workers even without the revised bulletin) that I dont know what the regulations are worth anymore...

I was kind of in similar situation in 2006 and during those days there was an email id for PA center where you can request for the screen shot of your case. I am not sure if that email method still works or not but you can give it a try to get screen shot.
Here is the format and email that I sent.

If you start using EAD it means you have abandoned your H1 status. You cannot work on both H1 & EAD at the same time.

My H1B stamp on passport expired a few yrs back. I have an approved I797 valid till April 2008. Can I travel on this AP and come back and be on H1B? Do I have to use EAD(once I come back from India) if I use AP?

you can get the transit visa at the dubai airport. just ask at the customer service booth. they will guide you to a travel center, where the person making the hotel reservation will sponsor the visa for you. The hotel actually sponsors the visa. it will all be done in less than an hour.
