Sure Krishna - i'll definitely spend 400-500 bucks (because its worth spending)and ask this to Murthy/Rajiv/someone of that stature, when the time comes. But before that just trying gets all of urs opinion and plan doing something practical - you know :)
Look - 140 once approved can be theoritically revoked but it actually gets locked in your name and AC21 will guard your 485 for ever. But why that same thing wont protect the 3 yr H1B which was awarded based on the fact that your 485 is pending and 140 approved ?

one doesn't need an arranged employment to get a Canadian PR.you need to take the assessment and if you get 67 or more points you are covered. Having arranged employment will improve your score and of course getting PR
the reason you need NOC list is some where you need to mention in the application

Regarding the skills requirement, I was looking at this link (http://www.cic.gc.ca/english/immigrate/skilled/apply-who-instructions.asp#list) and didn't find 'Software Engineers' in the list.
As regards the other job titles in the NOC list, I thought I'd need an offer for arranged employment to apply in that category.
Please let me know if job titles in the NOC list qualify for the Federal Skilled Worker category without the need for arranged employment.

Going through the thread, i realized that it is highly confusing... No one knows anything for sure... I suggest that the best course is to get a legal advise from a qualifying attorney.....

There are many countries specially in middle east which does the same thing. This nation gives you freedom fredom of speech, freedom of peaceful assembly, collectively known as 1st Ammendment and its not restricted to citizen but for all resident.

Assuming a person on H1 gets married abroad and gets his wife on H-4 (H-1 dependent), and the person on H-1 gets green card 6 to 7 months after marriage, where does that leave the H-4 based wife?
Given that most of the members have already applied for I-485 and also given that a newly married cannot apply for derivative I-485 as soon as he/she lands here - is that a loophole or I missed something?
I know a friend of mine who had to go through this same scenario. They were seperated for 2 years and last year, he lost hope and left to home country in March 07 and I did informed him about the July Feasco as soon as it opened up in June and he was upset a bit on his decision. He decided to stick to it and happy living with family in home country. He is doing perfectly fine though. Of course he visited the family many times during those 2 years.

I have to just pay 100 Dollars , i will get my EAD ...

Basically we want to see if all EADs are being approved within or before 70- 90 days. We want to see how fee increase maybe linked to such delays. Could someone look at the information on this thread from our IV membership and post some trend. Do not include data from other sites. We are focussed only on IV member concerns and their genuine data on IV forums. If we see USCIS delays go beyond their 90 day period for several of our members, we can have a case to fight for faster approvals
IV wants to help its members in getting their renewals in time.

This is scary. Not to mention that people who have passed the driving tests are good drivers.... but you are inviting lot of trouble if you issue DL with out a test. Or is it that the state of NJ cannot afford to employ officers to test?

No.. actually a lot of states issue you a DL based on the written exam provided that you have a foerign/international DL. Giving a road test is not a true indicator of how a person really drives on a daily basis. If it were, we won't have so many accidents on the road or high insurance premiums for that matter... anyway.. to each his own..

Hello,
Here is a situation. Me and my wife have been permanent residents for the last 5 years and apply for citizenship. I was the primary applicant when our Green Cards were processed.
Our daughter who is born in the US is citizen by birth. My wife applies for Naturalized citizenship and I do not. Once she gets her citizenship and decide to go back to my home country (entire family). Here are couple of questions that I would like to ask:
1. What will be my status after I go back to my home country.
2. What will be the status of my wife?
3. Let us say I lose the permanent residency status, can I in the future become a naturalized citizen based upon my wife's status.
Please advise.

It might also be useful to indicate our skill levels in a sutiable way. People should realise we are Doctors, Engineers and Professors. It will give us crediablity and will raise us above slurs like the ones someone shouted at the SJ rally.

Please don't generalize a problem and scold some one based on race,sex, ethnicity and linguistic basic, this is really a sensitive matter and it may offend someone.

My friend initially came on H1 visa. Her Husband was the primary applicant for Green Card and she was working on H1 visa without break. Now she is on EAD and joined a job in EAD got 2 months pay stubs( ie 8 weekly pay stubs). After that got 3 months break. Her status now is on I-485 and no more on H1. Note: Her husband was the primary applicant and she applied I-485 through her husband's GC. Now will the break in her work on EAD be a problem for getting her GC?.

But now she is on her EAD and I believe once she changed and worked on EAD she is no more on her H1 status. Her status should be I-485 status. So does that still means that she needs to be working without break, to maintain the status?
